PAG LIN 1 1 Amend Senate File 2429, as passed by the Senate, as 1 2 follows: 1 3 #1. Page 17, by inserting after line 25 the 1 4 following: 1 5 "Sec. . Section 135.105B, Code 1999, is amended 1 6 to read as follows: 1 7 135.105BVOLUNTARY GUIDELINES HEALTH AND1 8ENVIRONMENTAL MEASURESMODEL LEAD HAZARD REMEDIATION 1 9 REQUIREMENTS CONFIRMED CASES OF LEAD POISONING. 1 10 1. The departmentmay develop voluntary guidelines1 11which may be used to develop and administer local1 12programsshall establish by rule model lead hazard 1 13 remediation requirements for residential properties to 1 14 address the health and environmental needs of children 1 15 who are confirmed as lead poisoned. The purpose of 1 16 the requirements shall be to prevent ongoing and 1 17 future exposure to lead-based paint hazards. Local 1 18 boards of health may adopt and enforce the 1 19 requirements or may adopt the requirements and request 1 20 that the requirements be enforced by the state. 1 21 However, local boards of health shall not be required 1 22 to adopt and enforce the requirements. The state may 1 23 not enforce the requirements unless the requirements 1 24 have been adopted by the local board of health and the 1 25 local board of health has requested that the state 1 26 enforce the requirements. 1 27 2. Thevoluntary guidelinesmodel lead hazard 1 28 remediation requirements may be based upon existing 1 29 local ordinances that addressthe medical case1 30management of children's health needs andthe 1 31 mitigation of the environmental factors which 1 32 contributed to the lead poisoning. 1 333. Following development of the voluntary1 34guidelines, cities or counties may elect to utilize1 35the guidelines in developing and administering local1 36programs through city or county health departments on1 37a city, county, or multicounty basis or may request1 38that the state develop and administer the local1 39program. However, cities and counties are not1 40required to develop and administer local programs1 41based upon the guidelines." 1 42 #2.
