Section 8D.3, subsection 3, paragraph 1 14 f, Code Supplement 1999, is amended to read as 1 15 follows: 1 16 f. Annually prepare a written five-year financial 1 17 plan for the network which shall be provided to the 1 18 information technology council for delivery to the 1 19 general assembly and the governor by no later than 1 20 January 15 of each year. The plan shall include 1 21 estimates for income and expenses for the network for 1 22 the five-year period and the actual income and 1 23 expenses for the preceding fiscal year. The plan 1 24 shall include the amount of general fund 1 25 appropriations to be requested for the payment of 1 26 operating expenses and debt service. The plan shall 1 27 also include any recommendations of the commission 1 28 related to changes in the system and other items as 1 29 deemed appropriate by the commission. The 1 30 recommendations of the commission contained in the 1 31 plan shall include a detailed plan for the connection 1 32 of all public schools to the network, including a 1 33 discussion and evaluation of all potential financing 1 34 options, an estimate of all costs incurred in 1 35 providing such connections, and a schedule for 1 36 completing such connections, including the anticipated 1 37 final completion date for such connections. 1 38 Sec. . Section 8D.6, Code 1999, is amended to 1 39 read as follows: 1 40 8D.6 ADVISORY GROUPS ESTABLISHED. 1 41 1. The commission shall establish an advisory 1 42 group to examine the use of the network for 1 43 telemedicine applications. The advisory group shall 1 44 consist of representatives of hospitals and other 1 45 health care facilities as determined by the 1 46 commission. The advisory group shall provide advice 1 47 to the commission, the department, and the information 1 48 technology council. 1 49 2. The commission may establish other advisory 1 50 committees as necessary representing authorized users 2 1 of the network. An advisory committee established by 2 2 the commission shall provide advice to the commission, 2 3 the department, and the information technology 2 4 council. 2 5 Sec. . Section 8D.7, Code 1999, is amended to 2 6 read as follows: 2 7 8D.7 TELECOMMUNICATIONS ADVISORY COMMITTEE. 2 8 A telecommunications advisory committee is 2 9 established to advise the commission, the department, 2 10 and the information technology council on 2 11 telecommunications matters. The commission shall 2 12 appoint five members to the advisory committee who 2 13 shall represent specific telecommunications industries 2 14 or persons with technical expertise related to the 2 15 network. 2 16 Sec. . Section 8D.10, Code 1999, is amended to 2 17 read as follows: 2 18 8D.10 REPORT OF SAVINGS BY STATE AGENCIES. 2 19 A state agency which is a part of the network shall 2 20 annually provide a written report to the general 2 21 assembly and the information technology council 2 22 certifying the identified savings associated with the 2 23 state agency's use of the network. The report shall 2 24 be delivered on or before January 15 for the previous 2 25 fiscal year of the state agency. 2 26 Sec. . Section 8D.12, Code 1999, is amended to 2 27 read as follows: 2 28 8D.12 DISPOSITION OF NETWORK APPROVAL OF 2 29 GENERAL ASSEMBLY AND GOVERNOR. 2 30 Notwithstanding any provision to the contrary, the 2 31commissioninformation technology department or the 2 32 department of general services shall not sell, lease, 2 33 or otherwise dispose of the network without prior 2 34 authorization by a constitutional majority of each 2 35 house of the general assembly and approval by the 2 36 governor." 2 37 #5. Page 19, by inserting after line 25 the 2 38 following: 2 39 "Sec. . DIRECTIONS TO CODE EDITOR. The Code 2 40 editor shall transfer the provisions of chapter 8D to 2 41 chapter 14B, as enacted in this Act, and codify the 2 42 provisions as a separate subchapter in chapter 14B." 2 43 #6.
