By striking page 97, line 9 through page 1 8 100, line 9, and inserting the following: 1 9 "The Iowa energy center and center for global and 1 10 regional environmental research shall conduct 1 11 environmental assessments. The Iowa energy center and 1 12 center for global and regional environmental research 1 13 shall each provide a written annual report to the 1 14 board which describes each center's activities and the 1 15 results that each center has accomplished. Each 1 16 report shall include an explanation of initiatives and 1 17 projects of importance to the state."" 1 18 #2. Page 14, by striking line 12 and inserting the 1 24 following: "surcharge. 1 25 5A. FUNDING NONBYPASSABLE SURCHARGE. 1 26 a. The programs established in this section shall 1 27 be funded by all end-use consumers through a 1 28 nonbypassable monthly surcharge on all distribution 1 29 services within a delivery service provider's assigned 1 30 service area, including service provided under rates 1 31 or charges pursuant to section 476B.8. The monthly 1 32 surcharge shall be collected by the person billing the 1 33 end-use consumer for the service. The monthly 1 34 surcharge shall commence with bills issued on October 1 35 1, 2002. The monthly surcharge for each customer 1 36 class shall be as follows: 1 37 (1) One dollar and fifty cents for a residential 1 38 electric account. 1 39 (2) One dollar and fifty cents for a 1 40 nonresidential electric account with an annual usage 1 41 of less than twenty-five thousand kilowatt-hours in 1 42 the prior calendar year. 1 43 (3) Ten dollars for a nonresidential electric 1 44 account with an annual usage of twenty-five thousand 1 45 kilowatt-hours to one hundred thousand kilowatt-hours 1 46 in the prior calendar year. 1 47 (4) Thirty-six dollars for a nonresidential 1 48 electric account with an annual usage of more than one 1 49 hundred thousand kilowatt-hours to four hundred 1 50 thousand kilowatt-hours in the prior calendar year. 2 1 (5) One hundred fifty dollars for a nonresidential 2 2 electric account with an annual usage of more than 2 3 four hundred thousand kilowatt-hours to one million 2 4 five hundred thousand kilowatt-hours in the prior 2 5 calendar year. 2 6 (6) Seven hundred fifty dollars for a 2 7 nonresidential electric account with an annual usage 2 8 of more than one million five hundred thousand 2 9 kilowatt-hours to six million kilowatt-hours in the 2 10 prior calendar year. 2 11 (7) Six thousand dollars for a nonresidential 2 12 electric account with an annual usage of more than six 2 13 million kilowatt-hours in the prior calendar year. 2 14 b. All moneys collected pursuant to this 2 15 subsection shall be remitted to the treasurer of the 2 16 state and deposited as follows: 2 17 (1) Twenty-three million five hundred thousand 2 18 dollars in a separate account to be used for the low- 2 19 income affordability program and a low-income energy 2 20 efficiency program as provided under subsection 1. 2 21 The treasurer shall make disbursements from this 2 22 account as appropriate. Notwithstanding section 8.33, 2 23 the unencumbered or unobligated moneys remaining at 2 24 the end of any fiscal year from the allocation made in 2 25 this subparagraph shall not revert but shall be 2 26 available for expenditure during subsequent fiscal 2 27 years until expended for the purposes for which 2 28 originally appropriated. Interest or earnings on 2 29 investments or time deposits of the moneys in the 2 30 account shall be retained for the purposes designated 2 31 under subsection 1. 2 32 After the third year of the program, the board 2 33 shall annually adjust the levels of surcharges on 2 34 electric accounts under paragraph "a" based on the 2 35 total program budget developed by the division. When 2 36 determining the per account charge, the board shall 2 37 not substantially deviate from the cost allocation 2 38 among consumer groups reflected in the initial funding 2 39 charges. Any increase in monthly surcharges as 2 40 provided in this subparagraph shall not go into effect 2 41 without prior approval by joint resolution as adopted 2 42 by the general assembly. 2 43 (2) Two million dollars in a separate account to 2 44 be used for environmental assessment as provided under 2 45 subsection 3. Eighty-five percent of the amounts 2 46 allocated to this account are appropriated to the Iowa 2 47 energy center created in section 266.39C. Fifteen 2 48 percent of the amounts allocated to this account are 2 49 appropriated to the center for global and regional 2 50 environmental research established by the state board 3 1 of regents. Notwithstanding section 8.33, the 3 2 unencumbered or unobligated moneys remaining in the 3 3 account at the end of any fiscal year shall not revert 3 4 and shall be retained by the centers for the purposes 3 5 designated. Notwithstanding section 12C.7, subsection 3 6 2, interest or earnings on investments or time 3 7 deposits of the moneys in the account shall be 3 8 retained and used for the purposes designated under 3 9 subsection 3. 3 10 The Iowa energy center and the center for global 3 11 and regional environmental research shall each provide 3 12 a report to the legislative fiscal committee on a 3 13 monthly basis regarding any expenditures of funds 3 14 associated with each center's activities under this 3 15 subparagraph. A monthly report shall cover a calendar 3 16 month and is due the tenth day of the following month. 3 17 (3) Fifty-three million five hundred thousand 3 18 dollars in the environmental fund created in 3 19 subsection 4. The treasurer of state shall make 3 20 disbursements from this fund as requested by the 3 21 department of natural resources. The unencumbered or 3 22 unobligated moneys remaining in the fund at the end of 3 23 any fiscal year shall not revert but shall be 3 24 available for expenditure during subsequent fiscal 3 25 years. Notwithstanding section 12C.7, subsection 2, 3 26 interest or earnings on investments or time deposits 3 27 of the moneys deposited in the environmental fund 3 28 shall be credited to the fund. 3 29 c. Amounts collected pursuant to this subsection 3 30 and remitted to the treasurer of state are 3 31 appropriated for the purposes provided in this 3 32 subsection and shall not be subject to appropriation 3 33 for any other purpose by the general assembly, but 3 34 shall be used only for the purposes set forth in this 3 35 section."" 3 36 #5.
