PAG LIN 1 1 Amend House File 2530 as follows: 1 2 #1. By striking page 157, line 24, through page 1 3 158, line 31, and inserting the following: 1 4 "1. PURPOSE. An intervenor fund in the amount of 1 5 two million one hundred thousand dollars is created, 1 6 to be administered by the board. The fund shall be 1 7 used to reimburse qualified not-for-profit entities 1 8 that intervene in rulemaking proceedings before the 1 9 board associated with rules that are required to be 1 10 proposed by a specific date established by chapter 1 11 476B. 1 12 2. INTERVENOR REQUIREMENTS. In a rulemaking 1 13 proceeding associated with rules that are required to 1 14 be proposed by a specific date established by chapter 1 15 476B, the board may compensate an intervenor 1 16 participating in the rulemaking proceeding that is not 1 17 a delivery service provider, competitive electric 1 18 service provider, or other entity engaged in the 1 19 electric business, for some or all of the reasonable 1 20 costs of participation in the proceeding if the board 1 21 finds both of the following: 1 22 a. The intervenor is a not-for-profit entity 1 23 having at least one hundred members who are residents 1 24 of this state. 1 25 b. Participation by the intervenor is necessary to 1 26 provide for the record an adequate presentation of a 1 27 significant position in which the not-for-profit 1 28 entity has a substantial interest, and such an 1 29 adequate presentation would not be possible without a 1 30 grant of compensation. 1 31 3. INTERVENOR FINANCING. The board shall 1 32 compensate a qualified not-for-profit entity up to ten 1 33 thousand dollars for the actual, reasonable costs 1 34 incurred by the entity in the rulemaking proceeding. 1 35 However, the board shall not award amounts for 1 36 reimbursement in excess of one hundred thousand 1 37 dollars per rulemaking proceeding. A qualified not- 1 38 for-profit entity may join with one or more other 1 39 qualified not-for-profit entities to intervene in a 1 40 rulemaking proceeding without prejudicing the 1 41 eligibility of any of the entities for compensation 1 42 under this section. If more than ten qualified not- 1 43 for-profit entities request reimbursement in a 1 44 rulemaking proceeding and the total amount requested 1 45 from all qualified not-for-profit entities is greater 1 46 than one hundred thousand dollars, the board shall 1 47 determine the method for distribution of the available 1 48 funding. 1 49 4. SOURCE OF FUNDS. A total of two million one 1 50 hundred thousand dollars shall be provided for 2 1 intervenor compensation from the interim funding 2 2 mechanism established under section 476B.13, 2 3 subsection 5, paragraph "c". The board shall request 2 4 up to two million one hundred thousand dollars, on an 2 5 as needed basis, for distribution to qualified not- 2 6 for-profit entities or for reimbursement of the 2 7 board's administrative expenses related to proceedings 2 8 involving such intervenors. Administrative expenses 2 9 shall not exceed one hundred thousand dollars in 2 10 total. 2 11 5. IMPLEMENTATION.
