1 3 #1. Page 7, by inserting after line 16 the
1 4 following:
1 5 "NEW SUBSECTION. 20A. "Other volunteer" means a
1 6 person who is not the department, a professional
1 7 designee of the department, or a qualified volunteer."
1 8 #2. Page 7, by inserting after line 16 the
1 9 following:
1 10 "NEW SUBSECTION. 28A. "Qualified volunteer" means
1 11 a person, other than the department or a professional
1 12 designee of the department, who has appropriate
1 13 technical expertise and collects water quality-related
1 14 data or information pursuant to a water monitoring
1 15 plan approved in advance by the department and uses
1 16 certified laboratories in accordance with section
1 17 455B.113."
1 18 #3. Page 7, by inserting after line 22 the
1 19 following:
1 20 "NEW SUBSECTION. 41A. "Unrefined data" means
1 21 water quality-related data or information collected by
1 22 any other volunteer."
1 23 #4. Page 7, by striking lines 28 through 30 and
1 24 inserting the following: "from studies and samples
1 25 collected as follows:
1 26 a. By the department, a professional designee of
1 27 the department, or a qualified volunteer.
1 28 b. Pursuant to a national pollutant discharge
1 29 elimination system (NPDES) permit.
1 30 For the purposes of this subsection,
1 31 "professional".
1 32 #5. Page 8, line 1, by inserting before the word
1 33 "plan" the following: "water monitoring".
1 34 #6. By striking page 8, line 34 through page 9,
1 35 line 2 and inserting the following:
1 36 "2. The department may use unrefined data as the
1 37 basis for taking an action pursuant to this section
1 38 only when all of the following conditions are met:
1 39 a. The department has reviewed the unrefined data
1 40 and confirmed its accuracy and appropriateness.
1 41 b. The department has given ninety days' public
1 42 notice of its intention to act based on the unrefined
1 43 data."
1 44 #7. Page 9, line 6, by inserting after the word
1 45 "information" the following: "related to water
1 46 quality".
