1 2 #1. Page 155, by striking lines 14 through 28 and
1 3 inserting the following: "impact of such workforce
1 4 reduction on its employees. An electric company shall
1 5 develop a workforce reduction plan not less than one
1 6 hundred and twenty days in advance of any planned
1 7 reduction in force caused by restructuring during the
1 8 period. The workforce reduction plan shall include
1 9 provisions for lump sum severance, lump sum early
1 10 retirement, lump sum reimbursements for medical
1 11 insurance, and lump sum tuition reimbursements which
1 12 are equivalent to the prevailing industry standard for
1 13 workforce reduction plans at the time the electric
1 14 company announces a workforce reduction. If the
1 15 employees are represented by a labor organization, the
1 16 electric utility shall negotiate in good faith with
1 17 the representatives of the affected workforce. If the
1 18 parties fail to reach an acceptable agreement, either
1 19 party may request binding arbitration. If the
1 20 employees are not represented by a labor organization
1 21 and will involuntarily lose employment, the electric
1 22 utility shall develop a workforce reduction plan
1 23 consistent with the requirements of this subsection
1 24 and to the satisfaction of the electric utility's
1 25 board of directors, if the electric utility is an
1 26 electric company, or its governing body, if the
1 27 electric utility is a consumer-owned utility. A
1 28 workforce reduction shall not occur unless the
1 29 electric utility complies with this subsection. For
1 30 the purpose of this section, the term".
