1 2 reprinted by the Senate, as follows:
1 3 #1. Page 6, by striking lines 16 through 23, and
1 4 inserting the following:
1 5 "4. Immunization is not required for a person's
1 6 enrollment in any elementary or secondary school or
1 7 licensed child care center if either of the following
1 8 applies:
1 9 a. The applicant, or if the applicant is a minor,
1 10 the applicant's parent or legal guardian, submits to
1 11 the admitting official a statement signed by a
1 12 physician, who is licensed by the state board of
1 13 medical examiners, that, in the physician's opinion,
1 14 the immunizations required would be injurious to the
1 15 health and well-being of the applicant or any member
1 16 of the applicant's family.
1 17 b. The applicant, or if the applicant is a minor,
1 18 the applicant's parent or legal guardian, submits an
1 19 affidavit signed by the applicant, or if the applicant
1 20 is a minor, the applicant's parent or legal guardian,
1 21 stating that the immunization conflicts with the
1 22 tenets and practices of a recognized religious
1 23 denomination of which the applicant is an adherent or
1 24 member.
1 25 The exemptions under this subsection do not apply
1 26 in times of emergency or epidemic as determined by the
1 27 state board of health and as declared by the director
1 28 of public health."
1 29 #2. Page 20, line 2, by inserting after the word
1 30 "department." the following: "This section shall not
1 31 be construed to require treatment of the infant's eyes
1 32 with a prophylactic solution if the infant's parent or
1 33 legal guardian states that such treatment conflicts
1 34 with the tenets and practices of a recognized
1 35 religious denomination of which the parent or legal
1 36 guardian is an adherent or member."
1 37 #3. Page 20, by striking line 7 and inserting the
1 38 following: "if the person is an adherent or member of
1 39 a church or religious".
1 40 #4. Page 20, by striking lines 14 through 16.
