  1  1    Amend House File 2368 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 321.1, subsection 32,
  1  5 unnumbered paragraph 1, Code supplement 1999, is
  1  6 amended to read as follows:
  1  7    "Implement of husbandry" means a vehicle or special
  1  8 mobile equipment manufactured, designed, or
  1  9 reconstructed for agricultural purposes and, except
  1 10 for incidental uses, exclusively used in the conduct
  1 11 of agricultural operations.  "Implements of husbandry"
  1 12 includes all-terrain vehicles operated in compliance
  1 13 with section 321.234A, fence-line feeders, and
  1 14 vehicles used exclusively for the application of
  1 15 organic or inorganic plant food materials, organic
  1 16 agricultural limestone, or agricultural chemicals.  To
  1 17 be considered an implement of husbandry, a self-
  1 18 propelled implement of husbandry must be operated at
  1 19 speeds of thirty-five miles per hour or less, except
  1 20 that a self-propelled implement of husbandry equipped
  1 21 with air brakes may be operated at speeds up to forty
  1 22 miles per hour.  "Reconstructed" as used in this
  1 23 subsection means materially altered from the original
  1 24 construction by the removal, addition, or substitution
  1 25 of essential parts, new or used.
  1 26    Sec.    .  Section 321.383, subsection 2, Code
  1 27 Supplement 1999, is amended to read as follows:
  1 28    2.  When operated on a highway in this state at a
  1 29 speed of thirty-five miles per hour or less, every
  1 30 farm tractor, or tractor with towed equipment, self-
  1 31 propelled implement of husbandry, road construction or
  1 32 maintenance vehicle, road grader, horse-drawn vehicle,
  1 33 or any other vehicle principally designed for use off
  1 34 the highway and any such tractor, implement, vehicle,
  1 35 or grader when manufactured for sale or sold at retail
  1 36 after December 31, 1971, shall be identified with a
  1 37 reflective device in accordance with the standards of
  1 38 the American society of agricultural engineers;
  1 39 however, this provision shall not apply to such
  1 40 vehicles when traveling in an escorted parade.  A
  1 41 self-propelled implement of husbandry equipped with
  1 42 air brakes which is operated at speeds up to forty
  1 43 miles per hour on a highway in this state shall also
  1 44 be identified with the reflective device.  If a person
  1 45 operating a vehicle drawn by a horse or mule objects
  1 46 to using a reflective device that complies with the
  1 47 standards of the American society of agricultural
  1 48 engineers for religious reasons, the vehicle may be
  1 49 identified by an alternative reflective device that is
  1 50 in compliance with rules adopted by the department.
  2  1 The reflective device or alternative reflective device
  2  2 shall be visible from the rear.  A vehicle other than
  2  3 those specified in this section shall not display a
  2  4 reflective device or an alternative reflective device.
  2  5 On Except as otherwise provided in this subsection, on
  2  6 vehicles operating at speeds above thirty-five miles
  2  7 per hour, the reflective device or alternative
  2  8 reflective device shall be removed or hidden from
  2  9 view."
