  1  1    Amend House File 2366 as follows:
  1  2    #1.  Page 1, by inserting after line 19 the
  1  3 following:
  1  4    "Sec. ___.  Section 229.13, Code 1999, is amended
  1  5 by adding the following new unnumbered paragraph:
  1  6    NEW UNNUMBERED PARAGRAPH.  The order entered by the
  1  7 court under this section shall continue for one year,
  1  8 subject to the provisions for discharge and
  1  9 termination under section 229.16, and the provisions
  1 10 for renewal of the order after a review hearing,
  1 11 pursuant to section 229.16A.
  1 12    Sec. ___.  NEW SECTION.  229.16A  REVIEW HEARING.
  1 13    1.  For any respondent who is subject to an order
  1 14 to receive hospitalization or treatment under this
  1 15 chapter, a review hearing may be conducted once every
  1 16 twelve months to determine whether or not the
  1 17 respondent shall remain under order to receive
  1 18 hospitalization or treatment, upon application by any
  1 19 party to the proceeding, or upon the court's own
  1 20 motion.
  1 21    2.  The review hearing shall be held no more than
  1 22 sixty days after the filing of an application or
  1 23 motion for a review hearing.
  1 24    3.  The court may enter an order pursuant to
  1 25 section 229.10 to ensure that a current psychological
  1 26 evaluation is on file prior to the time of the review
  1 27 hearing.  The order shall not include detention
  1 28 pursuant to section 229.11 unless the respondent is
  1 29 already committed to inpatient treatment, or unless
  1 30 there is no other reasonable alternative for obtaining
  1 31 the evaluation.
  1 32    4.  At the review hearing, all rights, procedures,
  1 33 and standards applicable in an initial hearing under
  1 34 this chapter shall apply.
  1 35    5.  The court shall order the continued
  1 36 hospitalization or treatment of the respondent for
  1 37 another one-year period if the court finds that the
  1 38 contention that the respondent has a serious mental
  1 39 impairment is sustained by clear and convincing
  1 40 evidence."
  1 41    #2.  Title page, line 1, by inserting after the
  1 42 word "Act" the following:  "relating to mental health
  1 43 commitments, by".
  1 44    #3.  Title page, line 2, by inserting after the
  1 45 word "treatment" the following:  ", and making certain
  1 46 related changes to inpatient commitment procedures".
  1 47    #4.  By renumbering as necessary.
