  1  1    Amend House File 2366 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 144B.2, Code 1999, is amended
  1  5 to read as follows:
  1  6    144B.2  DURABLE POWER OF ATTORNEY FOR HEALTH CARE.
  1  7    1.  A durable power of attorney for health care
  1  8 authorizes the attorney in fact to make health care
  1  9 decisions for the principal if the durable power of
  1 10 attorney for health care substantially complies with
  1 11 the requirements of this chapter.  A durable power of
  1 12 attorney for health care may be executed with regard
  1 13 to decisions related to the principal's physical
  1 14 condition, mental condition, or both physical and
  1 15 mental conditions.
  1 16    2.  A document executed prior to May 8, 1991,
  1 17 purporting to create a durable power of attorney for
  1 18 health care shall be deemed valid if the document
  1 19 specifically authorizes the attorney in fact to make
  1 20 health care decisions and is signed by the principal."
  1 21    #2.  Title page, line 1, by inserting after the
  1 22 word "Act" the following: "relating to mental health
  1 23 commitments, by".
  1 24    #3.  Title page, line 2, by inserting after the
  1 25 word "treatment" the following:  ", and relating to
  1 26 execution of powers of attorney for mental or physical
  1 27 conditions".
  1 28    #4.  By renumbering as necessary.
