  1  1    Amend House File 2409 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 56.2, Code Supplement 1999, is
  1  5 amended by adding the following new subsections:
  1  6    NEW SUBSECTION.  8A.  "Computer" means an
  1  7 electronic device that performs logical, arithmetical,
  1  8 and memory functions by manipulations of electronic or
  1  9 magnetic impulses, and includes all functions,
  1 10 connections, and connected and related devices that
  1 11 assist in input, output, processing, storage, computer
  1 12 programs, computer applications, and communication.
  1 13    NEW SUBSECTION.  13A.  "Electronic format" means
  1 14 data in a form that is readable by a computer,
  1 15 including its software programs, and is either entered
  1 16 directly into a computer, or transmitted via computer
  1 17 disk, modem, or internet.
  1 18    NEW SUBSECTION.  15A.  "General election cycle"
  1 19 means the period of time between the general election
  1 20 for a particular office, and the next general election
  1 21 for that office.
  1 22    NEW SUBSECTION.  15B.  "Internet" means the
  1 23 federated system of allied computer networks linked by
  1 24 telecommunication channels that is the international
  1 25 network that connects educational, scientific, and
  1 26 commercial institutions, and that may also be accessed
  1 27 by individuals."
  1 28    #2.  Page 1, by inserting after line 6 the
  1 29 following:
  1 30    "Sec.    .  Section 56.6, subsection 3, paragraph
  1 31 i, Code Supplement 1999, is amended to read as
  1 32 follows:
  1 33    i.  If a person listed under paragraph "b", "d",
  1 34 "e", or "f" as making a contribution or loan to or
  1 35 purchase from a candidate's committee meets either of
  1 36 the following criteria, the information relating to
  1 37 the person's status shall also be disclosed, as
  1 38 follows:
  1 39    (1)  If the person is related to the candidate
  1 40 within the third degree of consanguinity or affinity,
  1 41 the existence of that person's family relationship
  1 42 shall be indicated on the report.
  1 43    (2)  If the amount of the contribution, loan, or
  1 44 purchase from the candidate's committee equals or
  1 45 exceeds two hundred dollars, then the person's
  1 46 employer shall be indicated on the report.
  1 47    If the treasurer of a political committee shows
  1 48 that best efforts have been used to obtain, maintain,
  1 49 and submit the information required to be provided by
  1 50 this paragraph "i", any report of such committee shall
  2  1 be considered in compliance with this section.  The
  2  2 committee will only be deemed to have exercised best
  2  3 efforts to obtain, maintain, and report the required
  2  4 information if it complies with the following:
  2  5    (a)  All written solicitations for contributions
  2  6 shall include a clear request for the contributor's
  2  7 full name, mailing address, occupation, and name of
  2  8 employer, and include an accurate statement of the law
  2  9 regarding the collection and reporting of individual
  2 10 contributor identifications.
  2 11    (b)  For each contribution received aggregating in
  2 12 excess of two hundred dollars per calendar year which
  2 13 lacks required contributor information, the treasurer
  2 14 shall make at least one effort after the receipt of
  2 15 the contribution to obtain the missing information.
  2 16 Such effort shall consist of either a written request
  2 17 sent to the contributor or an oral request to the
  2 18 contributor documented in writing.  The written or
  2 19 oral request must be made no later than thirty days
  2 20 after receipt of the contribution.
  2 21    Sec.    .  NEW SECTION.  56.6A  ELECTRONIC FILING
  2 22 AND DISCLOSURE OF DISCLOSURE REPORTS.
  2 23    1.  Reports filed with the board pursuant to the
  2 24 requirements of section 56.6 shall be filed in an
  2 25 electronic format, according to the following:
  2 26    a.  Until the beginning of the general election
  2 27 cycle that concludes with the general election in
  2 28 2006, any candidate or political committee may submit
  2 29 data required by section 56.6 in an electronic format,
  2 30 as prescribed by rule.
  2 31    b.  Beginning with the general election cycle that
  2 32 concludes with the general election in 2004, any
  2 33 candidate, candidate's committee, or political
  2 34 committee which accepts contributions in excess of
  2 35 twenty thousand dollars in the aggregate, makes
  2 36 expenditures in excess of twenty thousand dollars in
  2 37 the aggregate, or incurs indebtedness in excess of
  2 38 twenty thousand dollars in the aggregate in any one
  2 39 calendar year shall submit data required by section
  2 40 56.6 in an electronic format, as prescribed by rule.
  2 41 This requirement shall apply to any candidate or
  2 42 committee that reaches the threshold, whether or not
  2 43 that candidate is running for election during the
  2 44 current general election cycle, or whether the
  2 45 committee is involved with a ballot issue for the
  2 46 current general election.
  2 47    c.  Beginning with the general election cycle that
  2 48 concludes with the general election in 2006, all
  2 49 candidates, candidate committees, and political
  2 50 committees shall submit data required by section 56.6
  3  1 in an electronic format, as prescribed by rule.  This
  3  2 requirement shall apply to any candidate or committee,
  3  3 whether or not that candidate is running for election
  3  4 during the current general election cycle, or whether
  3  5 the committee is involved with a ballot issue for the
  3  6 current general election.
  3  7    2.  Until the beginning of the general election
  3  8 cycle that concludes with the general election in
  3  9 2006, if any candidate for a particular office submits
  3 10 data in an electronic format, then the data for all
  3 11 other candidates for that office shall be maintained
  3 12 in an electronic format, as prescribed by rule.  The
  3 13 data for any candidate for that office that was not
  3 14 voluntarily submitted to the board in an electronic
  3 15 format by the candidate or the candidate's committee
  3 16 shall be entered into the computer database by the
  3 17 board.
  3 18    3.  Beginning January 1, 2000, all disclosure
  3 19 reports filed with the board pursuant to section 56.6
  3 20 shall be available for viewing on the internet in an
  3 21 electronic format that conveys the information in
  3 22 substantially the same form as the paper copy required
  3 23 by section 56.6.  This requirement shall apply to all
  3 24 reports filed by any candidate or committee, whether
  3 25 or not that candidate or committee is running in or is
  3 26 otherwise involved in an election during the current
  3 27 general election cycle.
  3 28    4.  Beginning with the general election cycle that
  3 29 concludes with the general election in 2004, all
  3 30 campaign finance data that is submitted to the board
  3 31 in an electronic format or is otherwise entered into
  3 32 the computer database shall be accessible to the
  3 33 public on the internet in a searchable database."
  3 34    #3.  Page 6, by inserting after line 2 the
  3 35 following:
  3 36    "Sec.    .  1999 Iowa Acts, chapter 136, section
  3 37 14, subsection 3, is amended to read as follows:
  3 38    3.  REPORT.  Not later than December 15, 1999 2000,
  3 39 the commission shall submit to the general assembly a
  3 40 report of the activities of the commission, together
  3 41 with a draft of legislation recommended by the
  3 42 commission to reform the campaign finance disclosure
  3 43 and related laws for consideration by the general
  3 44 assembly in the year 2000 2001 according to the
  3 45 provisions of this Act.
  3 46    Sec.    .  1999 Iowa Acts, chapter 136, section 15,
  3 47 is amended to read as follows:
  3 48    SEC. 15.  ASSIGNMENT OF LEGISLATION.  The
  3 49 legislation drafted by the commission shall be filed
  3 50 with each chamber on the first day of the legislative
  4  1 session beginning in the year 2000 2001, and
  4  2 immediately assigned to the committee on state
  4  3 government in each chamber."
