  1  1    Amend Senate File 2248, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 3, by inserting after line 26 the
  1  4 following:
  1  5    "Sec.    .  Section 261.19B, Code 1999, is amended
  1  6 to read as follows:
  1  7    261.19B  OSTEOPATHIC LOAN PHYSICIAN RECRUITMENT
  1  8 REVOLVING FUND.
  1  9    An osteopathic loan physician recruitment revolving
  1 10 fund is created in the state treasury as a separate
  1 11 fund under the control of the commission.  The
  1 12 commission shall deposit payments made by osteopathic
  1 13 loan physician recruitment recipients and the proceeds
  1 14 from the sale of osteopathic loans into the
  1 15 osteopathic loan revolving fund.  Moneys credited to
  1 16 the fund shall be used to supplement moneys
  1 17 appropriated for the osteopathic forgivable loan
  1 18 physician recruitment program, for loan forgiveness to
  1 19 eligible physicians and to pay for loan or interest
  1 20 repayment defaults by eligible physicians.
  1 21 Notwithstanding section 8.33, any balance in the fund
  1 22 on June 30 of any fiscal year shall not revert to the
  1 23 general fund of the state."
  1 24    #2.  Page 4, by inserting after line 9 the
  1 25 following:
  1 26    "Sec.    .  Section 261.86, subsection 2, Code
  1 27 Supplement 1999, is amended to read as follows:
  1 28    2.  The amount of educational Educational
  1 29 assistance received by a national guard member paid
  1 30 pursuant to this section shall be determined by the
  1 31 adjutant general and shall not exceed the resident
  1 32 tuition rate established for institutions of higher
  1 33 learning under the control of the state board of
  1 34 regents.  If the amount appropriated in a fiscal year
  1 35 for purposes of this section is insufficient to
  1 36 provide educational assistance to all national guard
  1 37 members who apply for the program and who are
  1 38 determined by the adjutant general to be eligible for
  1 39 the program, the adjutant general shall, in
  1 40 coordination with the commission, determine the amount
  1 41 distribution of educational assistance each eligible
  1 42 guard member shall receive.  However, educational
  1 43 assistance paid to an eligible national guard member
  1 44 pursuant to this section shall not be less than an
  1 45 amount equal to fifty percent of the resident tuition
  1 46 rate established for institutions of higher learning
  1 47 under the control of the state board of regents or
  1 48 fifty percent of the tuition rate at the institution
  1 49 attended by the national guard member, whichever is
  1 50 lower.  The adjutant general shall not determine
  2  1 Neither eligibility nor educational assistance amounts
  2  2 determinations shall be based upon a national guard
  2  3 member's unit, the location at which drills are
  2  4 attended, or whether the eligible individual is a
  2  5 member of the Iowa army or air national guard."
  2  6    #3.  Page 5, by inserting after line 15 the
  2  7 following:
  2  8    "Sec.    .  Section 261B.3A, Code 1999, is amended
  2  9 to read as follows:
  2 10    261B.3A  REQUIREMENT.
  2 11    A In order to register, a school offering courses
  2 12 or programs of study leading to a degree in the state
  2 13 of Iowa shall be accredited by an agency or
  2 14 organization approved or recognized by the United
  2 15 States department of education or a successor agency
  2 16 and be approved for operation by the appropriate state
  2 17 agencies in all other states in which it operates or
  2 18 maintains a presence college student aid commission.
  2 19    Sec.    .  Section 261B.4, subsection 9, Code 1999,
  2 20 is amended to read as follows:
  2 21    9.  Whether The name of the school is accredited by
  2 22 any accrediting agency recognized by the United States
  2 23 department of education or a successor agency and, if
  2 24 so, the name of the accreditation body which has
  2 25 accredited the school and the status under which
  2 26 accreditation is held.
  2 27    Sec.    .  Section 261B.9, subsection 6, Code 1999,
  2 28 is amended to read as follows:
  2 29    6.  Whether The name of the school is accredited by
  2 30 an accrediting agency recognized by the United States
  2 31 department of education or its successor agency which
  2 32 has accredited the school.
  2 33    Sec.    .  TRANSFER OF OSTEOPATHIC FORGIVABLE LOAN
  2 34 REVOLVING FUND MONEYS BY TREASURER.  On the effective
  2 35 date of this Act, the treasurer of state shall
  2 36 transfer any balance in the osteopathic forgivable
  2 37 loan program to the osteopathic physician recruitment
  2 38 revolving fund established pursuant to section 13 of
  2 39 this Act."
