1 14 "Sec. ___. NEW SECTION. 73A.25 CONSTRUCTION
1 15 MANAGEMENT CONTRACTS.
1 16 1. A political subdivision of this state shall
1 17 publish notice of intent to award a contract for
1 18 construction management services in relation to a
1 19 public improvement. The notice shall be published at
1 20 least thirty, but not more than sixty, days prior to
1 21 the award of the contract, in the manner provided in
1 22 section 618.14. The notice shall state the general
1 23 nature of the public improvement for which
1 24 construction management services are to be rendered,
1 25 the type of construction management services to be
1 26 rendered, and the time within which such services are
1 27 to be rendered.
1 28 2. A contract for construction management services
1 29 is not required to be let by sealed bids, provided
1 30 there is no guarantee of the cost of construction by
1 31 the person or entity providing the construction
1 32 management services.
1 33 3. This section applies to construction management
1 34 contracts for public improvements regulated by this
1 35 chapter, or chapter 331 or 384.
1 36 4. For purposes of this section, the following
1 37 definitions apply:
1 38 a. "Construction management services" mean any
1 39 services related in whole or in part to the planning,
1 40 design, scheduling, or administration of the
1 41 construction of a public improvement, except those
1 42 services required to be performed by a licensed
1 43 architect or engineer.
1 44 b. "Public improvement" means a building or other
1 45 construction work to be paid for in whole or in part
1 46 by the use of funds of a political subdivision."
