1 3 1. Page 5, by inserting after line 3 the
1 4 following:
1 5 "4A. EARNINGS CLAIMS. A franchisor may make an
1 6 earnings claim to a prospective franchisee only if the
1 7 following requirements are satisfied:
1 8 a. Reasonable proof is provided to support the
1 9 accuracy of the claim.
1 10 b. The claim is relevant to the prospective
1 11 franchisee's proposed location.
1 12 For the purposes of this subsection, "earnings
1 13 claim" means any oral, written, or visual
1 14 representation to a prospective franchisee for general
1 15 dissemination in the media which states or suggests a
1 16 specific level or range of potential or actual sales,
1 17 income, or gross or net profits. An earnings claim
1 18 includes, but is not limited to, projections, pro
1 19 forma statements, statements of actual historical
1 20 performance, cash flows, cost estimates at arbitrary
1 21 sales levels, and statements that suggest levels of
1 22 sales or profits."
