  1  1    Amend Senate File 324, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 5, by inserting after line 3 the
  1  4 following:
  1  5    "4A.  ADVERTISING FEES.  It shall be unlawful to
  1  6 collect any advertising fee from a franchisee and not
  1  7 use the funds for the purpose of advertising the
  1  8 business conducted by the franchisee.  With respect to
  1  9 collection and expenditure of advertising fees, the
  1 10 franchisor owes a fiduciary duty to the franchisor's
  1 11 franchisees."
  1 12    #2.  By renumbering as necessary.
