  1  1    Amend the Senate amendment, H-1536, to House File
  1  2 476, as amended, passed, and reprinted by the House,
  1  3 as follows:
  1  4    #1.  Page 2, by inserting after line 20 the
  1  5 following:
  1  6    "#   .  Page 21, by inserting after line 18 the
  1  7 following:
  1  8    "Sec.    .  Section 368.11, unnumbered paragraph 4,
  1  9 Code 1999, is amended to read as follows:
  1 10    At least ten thirty days before a petition for
  1 11 involuntary annexation is filed as provided in this
  1 12 section, the petitioner shall make its intention known
  1 13 by sending a letter of intent by certified mail to the
  1 14 council of each city whose urbanized area contains a
  1 15 portion of the territory, the board of supervisors of
  1 16 each county which contains a portion of the territory,
  1 17 the regional planning authority of the territory
  1 18 involved, each affected public utility, and to each
  1 19 property owner listed in the petition.  The written
  1 20 notification shall include notice that the petitioners
  1 21 shall hold a public meeting on the petition for
  1 22 involuntary annexation prior to the filing of the
  1 23 petition.
  1 24    Sec.    .  Section 368.11, Code 1999, is amended by
  1 25 adding the following new unnumbered paragraph after
  1 26 unnumbered paragraph 5:
  1 27    NEW UNNUMBERED PARAGRAPH.  In any case where the
  1 28 board of supervisors of the county in which the
  1 29 territory is located is not the petitioner, the board
  1 30 must, upon receipt of the letter of intent to annex,
  1 31 call a public meeting on the proposed petition.  The
  1 32 public meeting shall be held within ten days of
  1 33 receipt of such letter and shall be conducted by the
  1 34 board of supervisors.  Prior to the meeting, the board
  1 35 shall publish notice of the meeting in a newspaper of
  1 36 general circulation in the county.
  1 37    Sec.    .  Section 368.19, unnumbered paragraph 1,
  1 38 Code 1999, is amended to read as follows:
  1 39    The committee shall approve or disapprove the
  1 40 petition or plan as amended, within ninety days of the
  1 41 final hearing, and shall file its decision for record
  1 42 and promptly notify the parties to the proceeding of
  1 43 its decision.  The petition or plan must also be
  1 44 approved or disapproved by the board of supervisors of
  1 45 the county in which the territory is located within
  1 46 thirty days of a final determination on the petition
  1 47 or plan by the city development board.  In making its
  1 48 decision, the board of supervisors shall determine
  1 49 whether or not the annexation proposal conforms to the
  1 50 land use comprehensive plans of the county and of any
  2  1 cities located near the territory proposed to be
  2  2 annexed.
  2  3    PARAGRAPH DIVIDED.  If a petition or plan is
  2  4 approved by the city development board and the board
  2  5 of supervisors, the city development board shall set a
  2  6 date not less than thirty days nor more than ninety
  2  7 days after approval for a special election on the
  2  8 proposal and the county commissioner of elections
  2  9 shall conduct the election.  In a case of
  2 10 incorporation or discontinuance, registered voters of
  2 11 the territory or city may vote, and the proposal is
  2 12 authorized if a majority of those voting approves it.
  2 13 In a case of annexation or severance, registered
  2 14 voters of the territory and of the city may vote, and
  2 15 the proposal is authorized if a majority of the total
  2 16 number of persons voting approves it.  In a case of
  2 17 consolidation, registered voters of each city to be
  2 18 consolidated may vote, and the proposal is authorized
  2 19 only if it receives a favorable majority vote in each
  2 20 city.  The county commissioner of elections shall
  2 21 publish notice of the election as provided in section
  2 22 49.53 and shall conduct the election in the same
  2 23 manner as other special city elections.""
