  1  1    Amend Senate File 424, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 6, by inserting after line 19 the
  1  4 following:
  1  5    "Sec.    .  Section 321.491, unnumbered paragraph
  1  6 2, Code 1999, is amended to read as follows:
  1  7    Within ten days after the conviction or forfeiture
  1  8 of bail of a person upon a charge of violating any
  1  9 provision of this chapter or other law regulating the
  1 10 operation of vehicles on highways every magistrate of
  1 11 the court or clerk of the district court of record in
  1 12 which the conviction occurred or bail was forfeited
  1 13 shall prepare and immediately forward to the
  1 14 department an abstract of the record of the case.  The
  1 15 abstract must be certified by the person preparing it
  1 16 to be true and correct.  The clerk of the district
  1 17 court shall collect a fee of fifty cents for each
  1 18 individual copy of any record of conviction or
  1 19 forfeiture of bail furnished to any requestor at the
  1 20 clerk's office except for the department or other
  1 21 local, state, or federal government entity.  Moneys
  1 22 collected under this section shall be transferred to
  1 23 the department as a repayment receipt, as defined in
  1 24 section 8.2, to enhance the efficiency of the
  1 25 department to process records and information between
  1 26 the department and the Iowa court information system.
  1 27 Notwithstanding any other provision in this section or
  1 28 chapter 22, the judicial branch shall be the provider
  1 29 of public electronic access to the clerk's records of
  1 30 convictions and forfeitures of bail through the Iowa
  1 31 court information system and shall, if all such
  1 32 records are provided monthly to a vendor, the judicial
  1 33 branch shall effective retroactively to July 1, 1997,
  1 34 collect a fee from such vendor which is the greater of
  1 35 three thousand dollars per month or the actual direct
  1 36 cost of providing the records."
