1 5 "Sec. . NEW SECTION. 514C.19 MANDATED
1 6 COVERAGE FOR DENTAL CARE – ANESTHESIA AND CERTAIN
1 7 HOSPITAL CHARGES.
1 8 1. Notwithstanding section 514C.6, a policy or
1 9 contract providing for third-party payment or
1 10 prepayment of health or medical expenses shall provide
1 11 coverage for anesthesia and hospital charges related
1 12 to the provision of dental care services provided to
1 13 any of the following covered individuals:
1 14 a. A child under five years of age.
1 15 b. An individual who is severely disabled.
1 16 c. An individual who has a medical condition that
1 17 requires hospitalization or general anesthesia for
1 18 delivery of the dental care services.
1 19 2. A policy or contract providing for third-party
1 20 payment or prepayment of health or medical expenses
1 21 shall provide coverage for general anesthesia and
1 22 treatment rendered by a dentist for conditions covered
1 23 under such policy or contract, whether the services
1 24 are provided in a hospital or a dental office.
1 25 3. Prior authorization of hospitalization for
1 26 dental care procedures may be required in the same
1 27 manner that prior authorization is required for
1 28 hospitalization for other coverage under the contract
1 29 or policy.
1 30 4. This section applies to the following contracts
1 31 or policies delivered, issued for delivery, continued,
1 32 or renewed in this state on or after July 1, 1999:
1 33 a. Individual or group accident and sickness
1 34 insurance providing coverage on an expense-incurred
1 35 basis.
1 36 b. An individual or group hospital or medical
1 37 service contract issued pursuant to chapter 509, 514,
1 38 or 514A.
1 39 c. An individual or group health maintenance
1 40 organization contract regulated under chapter 514B.
1 41 d. An individual or group Medicare supplemental
1 42 policy, unless coverage pursuant to such policy is
1 43 preempted by federal law.
1 44 e. An organized delivery system licensed by the
1 45 director of public health."
1 46 #2. Title page, line 2, by inserting after the
1 47 word "care," the following: "anesthesia and certain
1 48 hospital charges associated with dental care
1 49 services,".
1 50 #3. By renumbering as necessary.
