Section 257.31, subsection 5, paragraph 1 6 j, Code 1999, is amended to read as follows: 1 7 j. Unusual need to continue providing a program or 1 8 other special assistance to non-English speaking 1 9 pupils after the expiration of thethree-yearfour- 1 10 year period specified in section 280.4. 1 11 Sec. . Section 280.4, subsection 3, Code 1999, 1 12 is amended to read as follows: 1 13 3. In order to provide funds for the excess costs 1 14 of instruction of limited English proficient students 1 15 above the costs of instruction of pupils in a regular 1 16 curriculum, students identified as limited English 1 17 proficient shall be assigned an additional weighting 1 18 of twenty-five hundredths, and that weighting shall be 1 19 included in the weighted enrollment of the school 1 20 district of residence for a period not exceedingthree1 21 four years. However, the school budget review 1 22 committee may grant supplemental aid or modified 1 23 allowable growth to a school district to continue 1 24 funding a program for students after the expiration of 1 25 thethree-yearfour-year period.The school budget1 26review committee shall calculate the additional amount1 27for the weighting to the nearest one-hundredth of one1 28percent so that to the extent possible the moneys1 29generated by the weighting will be equivalent to the1 30moneys generated by the two-tenths weighting provided1 31prior to July 2, 1991." 1 32 #2.
