  1  1    Amend the amendment, H-1227, to House File 723, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 3 the
  1  4 following:
  1  5    ""Sec.    .  Section 708.2A, Code 1999, is amended
  1  6 by striking subsections 2 through 5, and inserting the
  1  7 following in lieu thereof:
  1  8    1.  A person who commits domestic abuse assault is
  1  9 guilty of a class "D" felony.
  1 10    Sec.    .  Section 708.2A, subsection 6, paragraph
  1 11 a, Code 1999, is amended by striking the paragraph.
  1 12    Sec.    .  Section 708.2A, subsection 6, paragraph
  1 13 b, Code 1999, is amended to read as follows:
  1 14    b.  A person convicted of violating subsection 4
  1 15 this section shall be sentenced as provided under
  1 16 section 902.9, subsection 4, committed to the custody
  1 17 of the director of the department of corrections, and
  1 18 shall be assessed a fine of at least seven hundred
  1 19 fifty dollars.  The person shall be denied parole or
  1 20 work release until the person has served a minimum of
  1 21 one year of the person's sentence.  Notwithstanding
  1 22 section 901.5, subsection 3, and section 907.3,
  1 23 subsection 3, the person cannot receive a suspended or
  1 24 deferred sentence or a deferred judgment; however, the
  1 25 person sentenced shall receive credit for any time the
  1 26 person was confined in a jail or detention facility
  1 27 following arrest.
  1 28    Sec.    .  Section 708.2A, subsection 9, Code 1999,
  1 29 is amended to read as follows:
  1 30    9.  In addition to the mandatory minimum term of
  1 31 confinement imposed by subsection 6, paragraph "a",
  1 32 the The court shall order a person convicted under
  1 33 subsection 2 or 3 this section to participate in a
  1 34 batterers' treatment program as required under section
  1 35 708.2B.  In addition, as a condition of deferring
  1 36 judgment or sentence pursuant to section 907.3, the
  1 37 court shall order the person to participate in a
  1 38 batterers' treatment program.  The clerk of the
  1 39 district court shall send a copy of the judgment or
  1 40 deferred judgment to the judicial district department
  1 41 of correctional services."
