1 3 #1. Page 13, by inserting after line 21 the
1 4 following:
1 5 "In addition to an action to enforce the review
1 6 decision, or the decision of the court on appeal, the
1 7 enrollee shall have a cause of action against the
1 8 carrier or organized delivery system for any further
1 9 harm incurred after the rendering of the external
1 10 review decision or decision of the court on appeal,
1 11 and caused by any substantial noncompliance with the
1 12 external review decision or court decision by the
1 13 carrier or organized delivery system. The carrier or
1 14 organized delivery system's failure to substantially
1 15 comply with an external review decision, or decision
1 16 of the court on appeal, within twenty-four hours of
1 17 the decision, shall be prima facie evidence of bad
1 18 faith."
