PAG LIN 1 1 Amend House File 608 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. Section 462A.2, Code 1999, is amended 1 5 by adding the following new subsections: 1 6 NEW SUBSECTION. 12A. "Lanyard" means a cord, 1 7 rope, or wire which connects an operator to a 1 8 motorboat or motorized vessel and is designed to stop 1 9 the motor when disconnected. 1 10 NEW SUBSECTION. 22A. "Personal watercraft" means 1 11 a vessel, less than sixteen feet in length, which is 1 12 propelled by a water jet pump or similar machinery as 1 13 its primary source of motor propulsion and is designed 1 14 to be operated by a person sitting, standing, or 1 15 kneeling on the vessel rather than being operated by a 1 16 person sitting, standing, or kneeling inside the 1 17 vessel. 1 18 Sec. . Section 462A.6A, subsection 4, Code 1 19 1999, is amended to read as follows: 1 20 4. A sailboard.However, the registration decal1 21shall be attached to the bottom surface of the bow.1 22 Sec. . Section 462A.9, subsection 6, Code 1999, 1 23 is amended to read as follows: 1 24 6. a.EveryThe owner or operator of each vessel 1 25 shall provide that the vessel carry at least one life 1 26 preserver, life belt, ring buoy, or other device,of1 27the sortas prescribed by the rules of the commission, 1 28 for each passenger, so placed as to be readily 1 29 accessible. This does not apply to a vessel which is 1 30 a racing shell used in the sport of sculling or to a 1 31 sailboard while used for windsurfing. 1 32 b. A person shall not operate a personal 1 33 watercraft unless each person aboard is wearing an 1 34 approved personal flotation device as prescribed by 1 35 rule of the commission. 1 36 Sec. . Section 462A.9, Code 1999, is amended by 1 37 adding the following new subsection: 1 38 NEW SUBSECTION. 6A. The owner of each personal 1 39 watercraft registered in the state shall affix a 1 40 proper operation decal on the vessel in a location 1 41 that is clearly visible to a person sitting in the 1 42 position of the operator. The department shall 1 43 provide proper operation decals to county recorders. 1 44 County recorders shall provide a proper operation 1 45 decal to each owner of a personal watercraft when the 1 46 watercraft is registered and assigned an 1 47 identification number. If the proper operation decal 1 48 is lost, mutilated, or becomes illegible, the owner 1 49 shall obtain a new decal as soon as possible from a 1 50 county recorder or the department. 2 1 Sec. . NEW SECTION. 462A.9A WATERCRAFT SAFETY 2 2 COURSES CERTIFICATION REQUIRED. 2 3 The department shall establish a watercraft safety 2 4 course approved by the commission not later than 2 5 January 15, 2000. The watercraft safety course shall 2 6 be administered by the department. A person who is 2 7 eleven years of age or older may enroll in an approved 2 8 watercraft safety course, but a person who is eleven 2 9 years of age and who has successfully completed the 2 10 course shall only be issued a certificate of 2 11 completion which becomes valid on the person's twelfth 2 12 birthday. The department may use other organizations 2 13 and volunteers for assistance in designing and 2 14 implementing the watercraft safety course. The 2 15 watercraft safety course shall include all watercraft 2 16 including personal watercraft in its curriculum and 2 17 shall be taught in at least twelve counties commencing 2 18 no later than January 15, 2000. Not later than 2 19 January 15, 2002, the watercraft safety course shall 2 20 be taught in at least one-half of the counties in this 2 21 state. Each person who successfully completes an 2 22 approved watercraft safety course shall be issued a 2 23 watercraft safety certificate. The initial watercraft 2 24 safety certificate shall be issued without a fee. A 2 25 duplicate watercraft safety certificate shall be 2 26 issued upon request upon payment of a fee of five 2 27 dollars. 2 28 Sec. . Section 462A.12, subsection 1, Code 2 29 1999, is amended to read as follows: 2 30 1.NoA person shall not operate any vessel, or 2 31 manipulate any water skis, surfboard, or similar 2 32 device in a careless, reckless, or negligent manner so 2 33 as to endanger the life, limb, or property of any 2 34 person. A person shall not operate a personal 2 35 watercraft in a manner that causes the personal 2 36 watercraft to become airborne while the personal 2 37 watercraft crosses the wake of another vessel within 2 38 one hundred feet of the other vessel. 2 39 Sec. . Section 462A.12, subsection 6, Code 2 40 1999, is amended by striking the subsection and 2 41 inserting in lieu thereof the following: 2 42 6. a. An owner or operator of any vessel 2 43 propelled by a motor of more than ten horsepower, 2 44 including an owner of a boat livery, shall not permit 2 45 any person under twelve years of age to operate the 2 46 vessel unless accompanied in or on the same vessel by 2 47 a responsible person of at least eighteen years of 2 48 age. However, commencing July 1, 2002, a person who 2 49 is twelve years of age or older but less than eighteen 2 50 years of age shall not operate any vessel propelled by 3 1 a motor of more than ten horsepower unless the person 3 2 has successfully completed an approved watercraft 3 3 safety course and has a watercraft safety certificate 3 4 in immediate possession or is accompanied in or on the 3 5 same vessel by a responsible person of at least 3 6 eighteen years of age. Watercraft safety certificates 3 7 from an approved course in another state or foreign 3 8 nation will meet the requirements of this section. A 3 9 person required to have a watercraft safety 3 10 certificate shall carry and shall exhibit the 3 11 certificate upon request of an officer of the 3 12 department. A person who is eleven years of age or 3 13 older may take and successfully complete a water 3 14 safety course, but the certificate of completion shall 3 15 not be valid until the person's twelfth birthday. A 3 16 violation of this paragraph is a simple misdemeanor as 3 17 provided in section 462A.13. 3 18 b. After July 1, 2000, an owner or operator of a 3 19 personal watercraft, including an owner of a boat 3 20 livery, shall not permit any person who is under 3 21 twelve years of age to operate a personal watercraft 3 22 unless accompanied on the same vessel by a responsible 3 23 person of at least eighteen years of age. A person 3 24 who is twelve years of age or older but less than 3 25 eighteen years of age shall not operate a personal 3 26 watercraft unless the person has successfully 3 27 completed an approved watercraft safety course and has 3 28 a water safety certificate in immediate possession or 3 29 is accompanied on the same vessel by a responsible 3 30 person of at least eighteen years of age. Watercraft 3 31 safety certificates from an approved course in another 3 32 state or foreign nation will meet the requirements of 3 33 this section. A person required to have a watercraft 3 34 safety certificate shall carry and shall exhibit the 3 35 certificate upon request of an officer of the 3 36 department. A violation of this paragraph is a simple 3 37 misdemeanor as provided in section 462A.13. 3 38 Sec. 101. Section 462A.12, subsection 6, paragraph 3 39 b, as enacted in this Act, is amended by striking the 3 40 paragraph. 3 41 Sec. . Section 462A.12, Code 1999, is amended 3 42 by adding the following new subsections: 3 43 NEW SUBSECTION. 12. A person operating a personal 3 44 watercraft equipped by the manufacturer with a 3 45 lanyard-type engine cutoff switch shall attach the 3 46 lanyard to the person's body, clothing, or personal 3 47 flotation device as appropriate for the specific 3 48 personal watercraft. 3 49 NEW SUBSECTION. 13. A person shall not operate a 3 50 personal watercraft at any time between sunset and 4 1 eight a.m. 4 2 NEW SUBSECTION. 14. A person shall not chase or 4 3 harass wild animals while operating a personal 4 4 watercraft. 4 5 Sec. . EFFECTIVE DATE. Section 101 of this Act 4 6 takes effect July 1, 2002." 4 7 #2.
