  1  1    Amend House File 686 as follows:
  1  2    #1.  Page 1, by striking everything after the
  1  3 enacting clause and inserting the following:
  1  4    "Section 1.  Section 147.13, subsection 8, Code
  1  5 1999, is amended to read as follows:
  1  6    8.  For dentistry and, dental hygiene, and dental
  1  7 assisting, dental examiners.
  1  8    Sec. 2.  Section 147.80, Code 1999, is amended by
  1  9 adding the following new subsection:
  1 10    NEW SUBSECTION.  27A.  Registration to practice as
  1 11 a dental assistant, registration to practice as a
  1 12 dental assistant under a reciprocal agreement, or
  1 13 renewal of registration to practice as a dental
  1 14 assistant.
  1 15    Sec. 3.  Section 153.14, Code 1999, is amended by
  1 16 adding the following new subsection:
  1 17    NEW SUBSECTION.  5.  Persons registered as dental
  1 18 assistants who are exclusively engaged in the practice
  1 19 of said profession.
  1 20    Sec. 4.  NEW SECTION.  153.16A  DENTAL ASSISTANTS.
  1 21    1.  A person shall not practice as a dental
  1 22 assistant unless the person has registered with the
  1 23 board of dental examiners and received a certificate
  1 24 of registration pursuant to this subsection.  A person
  1 25 shall be registered in accordance with one of the
  1 26 following:
  1 27    a.  As a registered dental assistant upon
  1 28 successful completion of education requirements,
  1 29 examination requirements, or both, as established by
  1 30 the board by rule.  Education requirements shall
  1 31 include classes in infection control, hazardous
  1 32 materials, and jurisprudence, and shall also include
  1 33 possession of a valid certificate in a nationally
  1 34 recognized course in cardiopulmonary resuscitation.
  1 35    b.  As a certified dental assistant, in addition to
  1 36 the requirements of paragraph "a", upon submission to
  1 37 the board of a valid certified dental assistant
  1 38 credential issued by the national board of dental
  1 39 assisting.
  1 40    c.  As an expanded-function dental assistant, in
  1 41 addition to the requirements of paragraphs "a" and
  1 42 "b", upon successful completion of a class in expanded
  1 43 functions approved by the board.
  1 44    2.  The board shall establish scope of practice,
  1 45 supervision, continuing education, and renewal
  1 46 requirements, and shall specify circumstances
  1 47 resulting in registration revocation or suspension, by
  1 48 rule.  Requirements established shall provide that a
  1 49 dental assistant registered pursuant to the provisions
  1 50 of subsection 1 may perform only those intraoral
  2  1 services which are mechanical in nature and require
  2  2 limited judgment, and shall not perform services
  2  3 involving the removal of any plaque, stain, calculus,
  2  4 or hard natural or synthetic material except by rubber
  2  5 cup coronal polish; administration of local
  2  6 anesthesia; and placement of sealants.
  2  7    3.  Individuals employed as a dental assistant as
  2  8 of July 1, 2000, shall have until September 1, 2000,
  2  9 to comply with the provisions of subsection 1.
  2 10 Individuals employed as a dental assistant after July
  2 11 1, 2000, shall have a sixty-day period following their
  2 12 first date of employment after July 1, 2000, to comply
  2 13 with the provisions of subsection 1.
  2 14    Sec. 5.  Section 153.34, unnumbered paragraph 1,
  2 15 Code 1999, is amended to read as follows:
  2 16    The board may issue an order to discipline a
  2 17 licensed dentist or dental hygienist, or registered
  2 18 dental assistant, for any of the grounds set forth in
  2 19 this chapter, chapter 272C, or Title IV.
  2 20 Notwithstanding section 272C.3, licensee or registrant
  2 21 discipline may include a civil penalty not to exceed
  2 22 ten thousand dollars.  Pursuant to this section, the
  2 23 board may discipline a licensee for any of the
  2 24 following reasons:
  2 25    Sec. 6.  Section 153.34, Code 1999, is amended by
  2 26 adding the following new unnumbered paragraph:
  2 27    NEW UNNUMBERED PARAGRAPH.  The board may discipline
  2 28 a registered dental assistant for violation of any
  2 29 applicable provision of this section.
  2 30    Sec. 7.  EFFECTIVE DATE.  This Act takes effect
  2 31 July 1, 2000."
