  1  1    Amend House File 620 as follows:
  1  2    #1.  Page 2, by inserting after line 19 the
  1  3 following:
  1  4    "Sec.    .  Section 321L.2, subsection 3, paragraph
  1  5 b, subparagraph (1), Code 1999, is amended to read as
  1  6 follows:
  1  7    (1)  A statement printed on it as follows:
  1  8 "Unauthorized use of this placard as indicated in Iowa
  1  9 Code chapter 321L may result in a fine, invalidation
  1 10 of the placard, or revocation of the right to use the
  1 11 placard.  This placard shall be displayed only when
  1 12 the vehicle is parked in a persons with disabilities
  1 13 parking space or in a parking space not designated as
  1 14 a persons with disabilities parking space if a
  1 15 wheelchair parking cone is used pursuant to Iowa Code
  1 16 section 321L.2A."
  1 17    Sec.    .  Section 321L.2A, Code 1999, is amended
  1 18 to read as follows:
  1 19    321L.2A  WHEELCHAIR PARKING CONE.
  1 20    1.  A person issued a persons with disabilities
  1 21 parking permit under section 321L.2 who uses a
  1 22 wheelchair may park in a persons with disabilities
  1 23 parking space, or a parking space not designated as a
  1 24 persons with disabilities parking space, and reserve
  1 25 up to an eight foot space adjacent to the motor
  1 26 vehicle for the purpose of exiting and entering the
  1 27 motor vehicle if all of the following conditions are
  1 28 met:
  1 29    a.  The person places a wheelchair parking cone
  1 30 within eight feet of the motor vehicle's entry.
  1 31    b.  The person displays the persons with
  1 32 disabilities parking permit in the motor vehicle as
  1 33 described in section 321L.4.
  1 34    c.  The motor vehicle and the wheelchair parking
  1 35 cone do not obstruct an aisle, street, or roadway so
  1 36 that other vehicles are unable to pass through the
  1 37 aisle, street, or roadway.
  1 38    d.  The parking space is provided by the state, a
  1 39 political subdivision of the state, or an entity
  1 40 providing nonresidential parking.
  1 41    2.  A person issued a persons with disabilities
  1 42 parking permit who does not comply with the
  1 43 requirements of subsection 1 when using a wheelchair
  1 44 parking cone commits a misdemeanor punishable by a
  1 45 scheduled fine under section 805.8, subsection 2,
  1 46 paragraph "a".
  1 47    3.  A person shall not interfere with a wheelchair
  1 48 parking cone properly placed under subsection 1.  A
  1 49 violation of this subsection is a misdemeanor
  1 50 punishable by a scheduled fine under section 805.8,
  2  1 subsection 2, paragraph "a".
  2  2    4.  The department, upon the request of a person
  2  3 issued a persons with disabilities parking permit
  2  4 under section 321L.2 who uses a wheelchair, shall
  2  5 provide the person with a list of names and addresses
  2  6 of vendors who sell wheelchair parking cones bearing
  2  7 the international symbol of accessibility and the
  2  8 words "wheelchair parking space".
  2  9    5.  The department shall adopt rules as necessary
  2 10 to administer this section."
  2 11    #2.  Page 2, line 32, by inserting after the word
  2 12 "space" the following:  ", except as provided in
  2 13 section 321L.2A".
  2 14    #3.  Page 3, by inserting after line 18 the
  2 15 following:
  2 16    "Sec.    .  Section 805.8, subsection 2, paragraph
  2 17 a, Code 1999, is amended to read as follows:
  2 18    a.  For parking violations under sections 321.236,
  2 19 321.239, 321.358, 321.360, and 321.361, the scheduled
  2 20 fine is five dollars.  The scheduled fine for a
  2 21 parking violation of section 321.236 increases in an
  2 22 amount up to ten dollars, as authorized by ordinance
  2 23 pursuant to section 321.236, subsection 1, paragraph
  2 24 "a", if the parking violation is not paid within
  2 25 thirty days of the date upon which the violation
  2 26 occurred.  For purposes of calculating the unsecured
  2 27 appearance bond required under section 805.6, the
  2 28 scheduled fine shall be five dollars.  However,
  2 29 violations charged by a city or county upon simple
  2 30 notice of a fine instead of a uniform citation and
  2 31 complaint as permitted by section 321.236, subsection
  2 32 1, paragraph "a", are not scheduled violations, and
  2 33 this section shall not apply to any offense charged in
  2 34 that manner.  For a parking violation under section
  2 35 321.362 or 461A.38 the scheduled fine is ten dollars.
  2 36 For a parking violation under section 321L.2A,
  2 37 subsection 2, the scheduled fine is twenty dollars.
  2 38 For interference with a wheelchair parking cone under
  2 39 section 321L.2A, subsection 3, or a parking violation
  2 40 under section 321L.4, subsection 2, the scheduled fine
  2 41 is one hundred dollars."
  2 42    #4.  Title page, line 1, by inserting after the
  2 43 word "disabilities" the following:  "by providing for
  2 44 the use of wheelchair parking cones, providing for
  2 45 persons with disabilities".
  2 46    #5.  Title page, line 2, by inserting after the
  2 47 word "trailers" the following:  ", and providing for
  2 48 penalties".
  2 49    #6.  By renumbering as necessary.
