PAG LIN 1 1 Section 1. Section 23A.2, subsection 1, Code l997, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. c. Enter into any contract or agreement 1 4 providing direct or indirect financial support, whether in 1 5 cash or in-kind services, to any nonprofit entity which sells 1 6 advertising for any publication if the commercial advertising 1 7 gross revenues of the publication exceed two hundred fifty 1 8 thousand dollars in any calendar year and if the nonprofit 1 9 entity has an agent or employee whose gross annual 1 10 compensation exceeds twelve thousand dollars, who is not a 1 11 full-time student and who directly or indirectly assists in 1 12 the solicitation of the advertising. 1 13 Sec. 2. Section 23A.2, subsection 2, paragraph a, Code 1 14 l997, is amended to read as follows: 1 15 a. Goods and services that are directly and reasonably 1 16 related to the educational mission of an institution or 1 17 school. However, an exemption shall not be provided pursuant 1 18 to this chapter with regard to activities, either directly or 1 19 through an affiliated nonprofit entity, which include the 1 20 selling of advertising for any publication if the commercial 1 21 advertising gross revenues of the publication exceed two 1 22 hundred fifty thousand dollars in any calendar year and if the 1 23 nonprofit entity has an agent or employee whose gross annual 1 24 compensation exceeds twelve thousand dollars, who is not a 1 25 full-time student and who directly or indirectly assists in 1 26 solicitation of the advertising. 1 27 Sec. 3. Section 23A.2, subsection 10, paragraph k, 1 28 subparagraph (9), Code l997, is amended to read as follows: 1 29 (9) Goods, products, or professional services which are 1 30 produced, created, or sold incidental to the schools' 1 31 teaching, research, and extension missions. However, an 1 32 exemption is not provided pursuant to this chapter with regard 1 33 to activities, either directly or through an affiliated 1 34 nonprofit entity, which include the selling of advertising for 1 35 any publication if the commercial advertising gross revenues 2 1 of the publication exceed two hundred fifty thousand dollars 2 2 in any calendar year and if the nonprofit entity has an agent 2 3 or employee whose gross annual compensation exceeds twelve 2 4 thousand dollars, who is a full-time student and who directly 2 5 or indirectly assists in the solicitation of the advertising. 2 6 EXPLANATION 2 7 This bill provides that government noncompetition laws do 2 8 not exempt government or government-affiliated nonprofit 2 9 entities engaging agents or employees who are not full-time 2 10 students to directly or indirectly solicit advertising for 2 11 publications receiving direct or indirect government or 2 12 government-affiliated support if the commercial gross 2 13 advertising revenues of the publication exceed $250,000 in any 2 14 calendar year and if the nonprofit entity has an agent or 2 15 employee whose gross compensation exceeds $12,000 annually, 2 16 who directly or indirectly assists in the solicitation of the 2 17 advertising, and who is not a full-time student. 2 18 LSB 4312SC 77 2 19 tj/sc/14
