PAG LIN 1 1 Section 1. Section 384.85, Code 1997, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 1A. a. Notwithstanding section 21.5, the 1 4 governing body of a city utility, combined utility system, 1 5 city enterprise, or combined city enterprise, by a vote of a 1 6 quorum of the members of the body, may hold a closed session 1 7 to discuss business matters and marketing and pricing 1 8 strategies if its competitive position would be harmed by 1 9 public disclosure not required of potential or actual 1 10 competitors, and if no public purpose would be served by such 1 11 disclosure. 1 12 b. Notwithstanding section 22.2, subsection 1, public 1 13 records of a city utility, combined utility system, city 1 14 enterprise, or combined city enterprise shall not include 1 15 records of customer names and accounts, records associated 1 16 with marketing or pricing strategies, and business records, if 1 17 its competitive position would be harmed by public disclosure 1 18 not required of potential or actual competitors, and if no 1 19 public purpose would be served by such disclosure. 1 20 EXPLANATION 1 21 This bill allows the governing body of a city utility, 1 22 combined utility system, city enterprise, or combined city 1 23 enterprise, by a vote of a quorum of the members of the body, 1 24 to conduct a closed session to discuss business matters and 1 25 marketing and pricing strategies if its competitive position 1 26 would be harmed by public disclosure of such information, the 1 27 disclosure of such information is not required of potential or 1 28 actual competitors, and no public purpose would be served by 1 29 such disclosure. 1 30 The bill also provides an exception from the public records 1 31 requirements of Code section 22.2, for the records of a city 1 32 utility, combined utility system, city enterprise, or combined 1 33 city enterprise for records which include customer names and 1 34 accounts, which are associated with marketing or pricing 1 35 strategies, and business records, if its competitive position 2 1 would be harmed by public disclosure of such records which is 2 2 not required of potential or actual competitors, and no public 2 3 purpose would be served by such disclosure. 2 4 LSB 4209SC 77 2 5 mj/sc/14
