1 1 Section 1. Section 455B.171, Code 1997, is amended by
1 2 adding the following new subsections:
1 3 NEW SUBSECTION. 1A. "Agricultural drainage well" means a
1 4 vertical opening to an aquifer or permeable substratum which
1 5 is constructed by any means including, but not limited to,
1 6 drilling, driving, digging, boring, augering, jetting,
1 7 washing, or coring, and which is capable of intercepting or
1 8 receiving surface or subsurface drainage water from
1 9 agricultural land directly or by a drainage system.
1 10 NEW SUBSECTION. 1B. "Agricultural drainage well area"
1 11 means an area of land where surface or subsurface water drains
1 12 into an agricultural drainage well directly or through a
1 13 drainage system connecting to the agricultural drainage well.
1 14 NEW SUBSECTION. 1C. "Anaerobic lagoon" means the same as
1 15 defined in section 455B.161.
1 16 NEW SUBSECTION. 7A. "Drainage system" means tile lines,
1 17 laterals, surface inlets, or other improvements which are
1 18 constructed to facilitate the drainage of agricultural land.
1 19 NEW SUBSECTION. 7B. "Earthen manure storage basin" means
1 20 the same as defined in section 455B.161.
1 21 Sec. 2. Section 455B.201, Code 1997, is amended by adding
1 22 the following new subsection:
1 23 NEW SUBSECTION. 5. A person shall not construct or expand
1 24 an anaerobic lagoon or an earthen manure storage basin within
1 25 an agricultural drainage well area.
1 26 EXPLANATION
1 27 This bill amends a provision in Code chapter 455B which
1 28 provides for minimum manure control practices, as regulated by
1 29 the department of natural resources. The bill prohibits a
1 30 person from constructing or expanding an anaerobic lagoon or
1 31 an earthen manure storage basin within an agricultural
1 32 drainage well area where surface or subsurface water drains
1 33 into an agricultural drainage well. A general civil penalty
1 34 provision contained in Code section 455B.191 applies to a
1 35 person who violates the bill. That Code section provides in
2 1 part that a violator is subject to a civil penalty of up to
2 2 $5,000 for each day of a violation.
