PAG LIN 1 1 Section 1. NEW SECTION. 100.31A SPRINKLER SYSTEMS IN 1 2 SCHOOL BUILDING CONSTRUCTION. 1 3 1. All public and nonpublic school buildings, additions to 1 4 school buildings, and any alteration, remodeling, renovation, 1 5 or reconstruction projects affecting one or more areas of a 1 6 public or nonpublic school building that are cumulatively 1 7 equal to fifty percent or more of the square footage of the 1 8 school building, which are approved for construction after 1 9 August 15, 1997, shall require the installation of an approved 1 10 sprinkler system designed and installed in conformity with 1 11 rules adopted by the state fire marshal pursuant to this 1 12 chapter. 1 13 2. The copy of the building plans submitted by the board 1 14 of directors of a school district to the building consultant 1 15 in the department of education for review pursuant to section 1 16 297.7 shall include the design and installation plans for the 1 17 automatic sprinkler system required under this section. 1 18 Sec. 2. Section 100.35, unnumbered paragraph 1, Code 1997, 1 19 is amended to read as follows: 1 20 The fire marshal shall adopt, and may amend rules under 1 21 chapter 17A, which include standards relating to exits and 1 22 exit lights, fire escapes, automatic sprinkler systems in 1 23 school buildings, fire protection, fire safety and the 1 24 elimination of fire hazards, in and for churches, schools, 1 25 hotels, theaters, amphitheaters, hospitals, health care 1 26 facilities as defined in section 135C.1, boarding homes or 1 27 housing, rest homes, dormitories, college buildings, lodge 1 28 halls, club rooms, public meeting places, places of amusement, 1 29 apartment buildings, food establishments as defined in section 1 30 137A.1, subsection 5, food service establishments as defined 1 31 in section 137B.2, subsection 6, and all other buildings or 1 32 structures in which persons congregate from time to time, 1 33 whether publicly or privately owned. Violation of a rule 1 34 adopted by the fire marshal is a simple misdemeanor. However, 1 35 upon proof that the fire marshal gave written notice to the 2 1 defendant of the violation, and proof that the violation 2 2 constituted a clear and present danger to life, and proof that 2 3 the defendant failed to eliminate the condition giving rise to 2 4 the violation within thirty days after receipt of notice from 2 5 the fire marshal, the penalty is that provided by law for a 2 6 serious misdemeanor. Each day of the continuing violation of 2 7 a rule after conviction of a violation of the rule is a 2 8 separate offense. A conviction is subject to appeal as in 2 9 other criminal cases. 2 10 Sec. 3. CONDITIONAL EFFECTIVE DATE. This Act shall not 2 11 take effect unless an appropriation is made which complies 2 12 with section 25B.2, subsection 3. 2 13 EXPLANATION 2 14 This bill provides that all public and nonpublic school 2 15 buildings, additions to school buildings, and any alteration, 2 16 remodeling, renovation, or reconstruction projects affecting 2 17 one or more areas of a public or nonpublic school building 2 18 that are cumulatively equal to 50 percent or more of the 2 19 square footage of the school building, which are approved for 2 20 construction after August 15, 1997, shall require the 2 21 installation of an approved sprinkler system designed and 2 22 installed in conformity with rules promulgated by the state 2 23 fire marshal, and directs the fire marshal to adopt rules 2 24 setting criteria or standards for automatic sprinkler systems 2 25 in new school building construction. 2 26 The copy of the building plans submitted by the board of 2 27 directors of a school district to the building consultant in 2 28 the department of education for review pursuant to section 2 29 297.7 shall include the design and installation plans for the 2 30 sprinkler system required under this section. 2 31 This bill may create a state mandate under section 25A.2. 2 32 The bill shall not take effect unless an appropriation under 2 33 section 25B.2, subsection 3, is made, fully funding the cost 2 34 of the bill or the state's proportionate share of the cost. 2 35 LSB 2195SC 77 3 1 kh/jj/8
