Senate Study Bill 141

  1  1    Section 1.  Section 904.107, Code 1997, is amended to read
  1  2 as follows:
  1  3    904.107  DIRECTOR – APPOINTMENT AND QUALIFICATIONS.
  1  4    The chief administrative officer for the department is the
  1  5 director.  The director shall be appointed by the governor
  1  6 subject to confirmation by the senate and shall serve at the
  1  7 pleasure of the governor.  The director shall be qualified in
  1  8 reformatory and prison management, knowledgeable in community-
  1  9 based corrections, and shall possess administrative ability.
  1 10 The director shall also have experience in the field of
  1 11 criminology and discipline and in the supervision of inmates
  1 12 in corrective penal institutions.  The director shall not be
  1 13 selected on the basis of political affiliation, and while
  1 14 employed as the director, shall not be a member of a political
  1 15 committee, participate in a political campaign, be a candidate
  1 16 for a partisan elective office, and shall not contribute to a
  1 17 political campaign fund, except that the director may
  1 18 designate on the checkoff portion of the state or federal
  1 19 income tax return, or both, a party or parties to which a
  1 20 contribution is made pursuant to the checkoff.  The director
  1 21 shall not hold any other office under the laws of the United
  1 22 States or of this or any state or hold any position for profit
  1 23 and shall devote full time to the duties of office.  
  1 24                           EXPLANATION
  1 25    This bill eliminates the requirement that the director of
  1 26 the department of corrections have experience in the
  1 27 supervision of inmates in corrective penal institutions.  The
  1 28 requirements that the director be qualified in prison
  1 29 management, knowledgeable in community-based corrections, and
  1 30 have experience in the field of criminology and discipline are
  1 31 retained.
