  1  1    Section 1.  Section 455F.1, subsection 4, Code 1997, is
  1  2 amended to read as follows:
  1  3    4.  "Household hazardous material" means a product used for
  1  4 residential purposes and designated by rule of the department
  1  5 of natural resources and may include any hazardous substance
  1  6 as defined in section 455B.411, subsection 2; and any
  1  7 hazardous waste as defined in section 455B.411, subsection 3;
  1  8 and shall include but is not limited to the following
  1  9 materials:  zinc carbon or lead batteries, toxic art supplies,
  1 10 used motor oils, motor oil filters, gasoline and diesel
  1 11 additives, kerosene, degreasers, waxes, polishes, pure
  1 12 solvents, paints, with the exception of latex-based paints,
  1 13 lacquers, thinners, caustic household cleaners, spot and stain
  1 14 remover with petroleum base, fluorescent or high intensity
  1 15 light bulbs, medical waste, ammunition, fireworks, banned or
  1 16 restricted use pesticides, and petroleum-based fertilizers.
  1 17 However, "household hazardous material" does not include
  1 18 laundry detergents or soaps, dishwashing compounds, chlorine
  1 19 bleach, personal care products, personal care soaps,
  1 20 cosmetics, and medications.
  1 21    Sec. 2.  Section 455F.8B, subsection 2, Code 1997, is
  1 22 amended by striking the subsection.
  1 23    Sec. 3.  Section 455F.9, Code 1997, is amended to read as
  1 24 follows:
  1 25    455F.9  EDUCATION PROGRAM.
  1 26    In addition to the "Toxic Cleanup Days" program the
  1 27 department shall implement a public information and education
  1 28 program regarding the proper use and disposal of household
  1 29 hazardous materials.  The program shall provide appropriate
  1 30 information concerning the reduction in use of the materials,
  1 31 including the purchase of smaller quantities and selection of
  1 32 alternative products the hazards associated with the use of
  1 33 unregistered and unregulated alternative products.  The
  1 34 department shall cooperate with existing educational
  1 35 institutions, the household product industry, distributors,
  2  1 wholesalers, and retailers, and other agencies of government
  2  2 and shall enlist the support of service organizations,
  2  3 whenever possible, in promoting and conducting the programs in
  2  4 order to effectuate the household hazardous materials policy
  2  5 of the state.
  2  6    Sec. 4.  Section 455F.3, Code 1997, is repealed.  
  2  7                           EXPLANATION
  2  8    This bill amends Code section 455F.1 by removing waxes,
  2  9 polishes, caustic household cleaners, and spot and stain
  2 10 removers with a petroleum base from the definition of
  2 11 household hazardous materials.  As a result, these materials
  2 12 are not included under the various labeling, permitting,
  2 13 collection, and education provisions of Code chapter 455F.
  2 14 The bill also adds zinc carbon or lead batteries, toxic art
  2 15 supplies, kerosene, fluorescent or high intensity light bulbs,
  2 16 medical waste, ammunition, fireworks, and banned or restricted
  2 17 use pesticides to the definition of household hazardous
  2 18 materials.  The bill also changes solvents to pure solvents
  2 19 and motor oils to used motor oils in the definition.
  2 20    The bill also repeals Code section 455F.3 relating to a
  2 21 labeling requirement for household hazardous materials.
  2 22 Currently, that Code section requires the following:
  2 23    1.  A retailer is required to affix a label near a display
  2 24 area of a household hazardous material, in most cases adjacent
  2 25 to price information for the material.
  2 26    2.  The department of natural resources shall develop and
  2 27 distribute a list of household hazardous products to be
  2 28 utilized in the labeling of display areas.
  2 29    3.  A person found in violation of the section is guilty of
  2 30 a simple misdemeanor.
  2 31    The bill removes the requirement that a recipient of a
  2 32 household hazardous waste reduction and collection program
  2 33 grant must establish an intensive three-year educational
  2 34 project.  The bill also provides that the department must
  2 35 provide information concerning hazards of alternative products
  3  1 in the public information and education program established in
  3  2 Code section 455F.9.
