1 1 Section 1. Section 562B.7, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 3A. "Good cause" means the failure of a
1 4 tenant to meet the obligations specified in section 562B.18,
1 5 or adhere to the rules and regulations prescribed in section
1 6 562B.19, subsections 1 and 2.
1 7 Sec. 2. Section 562B.10, subsection 4, Code 1997, is
1 8 amended to read as follows:
1 9 4. Rental agreements shall be for a term of one year
1 10 unless otherwise specified in the rental agreement. Rental
1 11 agreements shall be canceled by at least sixty days' written
1 12 notice given by either party, except as otherwise prescribed
1 13 in sections 562B.25 and 562B.25A. A sixty-day notice to
1 14 cancel a rental agreement initiated by a landlord shall be for
1 15 good cause. A landlord shall not cancel a rental agreement
1 16 solely for the purpose of making the tenant's mobile home
1 17 space available for another mobile home.
1 18 EXPLANATION
1 19 This bill provides that a 60-day notice to cancel a rental
1 20 agreement initiated by a landlord pursuant to Code section
1 21 562B.10, subsection 4, shall be for good cause. The bill
1 22 defines good cause as the failure of a tenant to meet the
1 23 tenant obligations specified in Code section 562B.18 relating
1 24 to maintenance of mobile home space, or to adhere to the
1 25 landlord rules and regulations prescribed in Code section
1 26 562B.19, subsections 1 and 2. The bill also provides that the
1 27 60-day written notice provision shall not apply to
1 28 circumstances involving a failure to pay rent or the creation
1 29 of a clear and present danger pursuant to Code sections
1 30 562B.25 and 562B.25A.
