PAG LIN 1 1 Section 1. Section 453A.13, subsection 3, Code 1997, is 1 2 amended to read as follows: 1 3 3. FEES – EXPIRATION. All permits provided for in this 1 4 division shall expire on June 30 of each year. A permit shall 1 5 not be granted or issued until the applicant has paid for the 1 6 period ending June 30 next, to the department or the city or 1 7 county granting the permit, the fees provided for in this 1 8 division. 1 9 a. The annual state permit fee for a distributor, 1 10 cigarette vendor, and wholesaler is one hundred dollars when 1 11 the permit is granted during the months of July, August, or 1 12 September. However, whenever a state permit holder operates 1 13 more than one place of business, a duplicate state permit 1 14 shall be issued for each additional place of business on 1 15 payment of five dollars for each duplicate state permit, but 1 16 refunds as provided in this division do not apply to any 1 17 duplicate permit issued. 1 18 b. The annual state fee for retail permits is as follows 1 19 when the permit is granted during the months of July, August, 1 20 or September: 1 21a.(1) In places outside any city, fifty dollars. 1 22b.(2) In cities of less than fifteen thousand population, 1 23 seventy-five dollars. 1 24c.(3) In cities of fifteen thousand or more population, 1 25 one hundred dollars. 1 26 c. If any permit is granted during the months of October, 1 27 November, or December, the fee shall be three-fourths of the 1 28above maximum scheduleannual fee; if granted during the 1 29 months of January, February, or March, one-half of themaximum1 30scheduleannual fee, and if granted during the months of 1 31 April, May, or June, one-fourth of themaximum scheduleannual 1 32 fee. 1 33 d. A city or county may establish a local retail permit 1 34 fee in addition to the annual state retail permit fee. A 1 35 local retail permit fee shall be retained by the city or 2 1 county imposing the fee and shall be used by the city or 2 2 county exclusively for the purpose of enforcing section 2 3 453A.2. 2 4 Sec. 2. Section 453A.56, Code 1997, is amended to read as 2 5 follows: 2 6 453A.56 UNIFORM APPLICATION. 2 7 1. Enforcement of this chapter shall be implemented in an 2 8 equitable manner throughout the state. For the purpose of 2 9 equitable and uniform implementation, application, and 2 10 enforcement of state and local laws and regulations, the 2 11 provisions of this chapter shall supersede any local law or 2 12 regulation which is inconsistent with or conflicts with the 2 13 provisions of this chapter. 2 14 2. Notwithstanding subsection 1, any local laws and 2 15 regulations specifically targeted to reduce or eliminate 2 16 access to, sale to, or use of cigarettes or tobacco products 2 17 by persons under eighteen years of age shall supersede any 2 18 inconsistent or conflicting provision of this chapter. 2 19 3. Notwithstanding subsection 1, a city or county may 2 20 establish a local retail permit fee which is in addition to 2 21 the annual state retail permit fee established pursuant to 2 22 section 453A.13. 2 23 EXPLANATION 2 24 This bill allows cities and counties to establish local 2 25 cigarette retail permit fees in addition to the existing 2 26 annual state retail permit fee. Any local fees collected are 2 27 to be used exclusively to enforce measures relating to the 2 28 prohibition of the sale, giving, or otherwise supplying of any 2 29 tobacco products or cigarettes to persons under the age of 18. 2 30 The bill also provides an exception to the uniform application 2 31 of the cigarette and tobacco provisions of chapter 453A for 2 32 establishing the local cigarette retail permit fees and for 2 33 local laws and regulations specifically targeted to reduce or 2 34 eliminate access to, sale to, or use by persons under the age 2 35 of 18 to cigarettes or tobacco products. 3 1 LSB 1284DP 77 3 2 pf/sc/14.1
