1 1 Section 1. All acts and proceedings taken by the board of
1 2 directors of the joint county system of Black Hawk and
1 3 Buchanan counties in connection with the transfer from the
1 4 joint county system of Black Hawk and Buchanan counties to the
1 5 Independence community school district of the following
1 6 described property are legalized, validated, and confirmed:
1 7 Commencing at a point thirty-nine (39) rods west of the
1 8 southeast corner of the southeast quarter (SE 1/4) of section
1 9 thirty-three (33), township eighty-nine (89) north, range nine
1 10 (9) west of the 5th P.M. in Buchanan county, Iowa, running
1 11 thence north three hundred thirty (330) feet, thence west two
1 12 hundred (200) feet, thence south three hundred thirty (330)
1 13 feet, thence east two hundred (200) feet, to the place of
1 14 beginning.
1 15 Sec. 2. The quitclaim deed for the transfer of the
1 16 property described in section 1 of this Act, signed by the
1 17 president of the board of directors of the joint county system
1 18 of Black Hawk and Buchanan counties, and which has been
1 19 recorded, is legalized, validated, and confirmed.
1 20 Sec. 3. This Act, being deemed of immediate importance,
1 21 takes effect upon its enactment.
1 22 EXPLANATION
1 23 This bill legalizes all acts and proceedings taken in 1974
1 24 by the board of directors of the joint county school system of
1 25 Black Hawk and Buchanan counties in connection with a transfer
1 26 of property to the Independence community school district. A
1 27 legalizing act was enacted in 1974 to put to rest doubts about
1 28 the authority of the joint county school system to transfer
1 29 property to the community school district. However, the legal
1 30 description of the property in the legislation was incorrect.
1 31 This bill corrects the legal description of the property
1 32 transferred and legalizes the quitclaim deed transferring the
1 33 property which was recorded. The bill takes effect upon its
1 34 enactment.
