1 1 Section 1. Section 514E.5, Code Supplement 1997, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 15. A device, chemical, or surgical
1 4 procedure that causes an abortion, unless medically necessary
1 5 to save the life of the patient, the pregnancy is the result
1 6 of a rape which is reported within forty-five days of the
1 7 incident to a law enforcement agency or public or private
1 8 health agency which may include a family physician, or the
1 9 pregnancy is the result of incest which is reported within one
1 10 hundred fifty days of the incident to a law enforcement agency
1 11 or public or private health agency which may include a family
1 12 physician.
1 13 EXPLANATION
1 14 This bill amends Code chapter 514E, the Iowa comprehensive
1 15 health insurance association chapter, by excluding from
1 16 coverage, costs associated with a device, chemical, or
1 17 surgical procedure that causes an abortion, unless medically
1 18 necessary to save the life of the patient, the pregnancy is
1 19 the result of a rape which is reported within forty-five days
1 20 of the incident to a law enforcement agency or public or
1 21 private health agency which may include a family physician, or
1 22 the pregnancy is the result of incest which is reported within
1 23 one hundred fifty days of the incident to a law enforcement
1 24 agency or public or private health agency which may include a
1 25 family physician. The Iowa comprehensive health insurance
1 26 association provides policies of health insurance coverage
1 27 only to persons who have been rejected for similar health
1 28 insurance coverage or only offered health insurance coverage
1 29 at a rate exceeding the association rate.
