PAG LIN 1 1 Section 1. Section 904A.1, Code 1997, is amended to read 1 2 as follows: 1 3 904A.1 BOARD OF PAROLE. 1 4 The board of parole is created to consist of five members. 1 5 Each member, except the chairperson and the vice chairperson, 1 6 shall be compensated on a day-to-day basis. Each member shall 1 7 serve a term of four years beginning and ending as provided by 1 8 section 69.19, except for members appointed to fill vacancies 1 9 who shall serve for the balance of the unexpired term. The 1 10 terms shall be staggered. The chairperson and vice 1 11 chairperson of the board shall beafull-time, salariedmember1 12 members of the board. A majority of the members of the board 1 13 constitutes a quorum to transact business. 1 14 Sec. 2. NEW SECTION. 904A.4C VICE CHAIRPERSON OF THE 1 15 BOARD OF PAROLE. 1 16 The vice chairperson of the board of parole shall be 1 17 appointed from the membership of the board of parole by a vote 1 18 of a majority of the members of the board. The vice 1 19 chairperson shall serve at the pleasure of the board and shall 1 20 have such responsibilities and duties as are determined by the 1 21 board. The vice chairperson shall act as the chairperson in 1 22 the absence or disability of the chairperson or in the event 1 23 of a vacancy in that office, until such time as a new 1 24 chairperson is appointed by the governor. 1 25 Sec. 3. Section 904A.6, Code 1997, is amended to read as 1 26 follows: 1 27 904A.6 SALARIES AND EXPENSES. 1 28 Each member, except the chairperson and the vice 1 29 chairperson, of the board shall be paid per diem as determined 1 30 by the general assembly. The chairperson and vice chairperson 1 31 of the board shall be paid a salary as determined by the 1 32 general assembly. Each member of the board and all employees 1 33 are entitled to receive, in addition to their per diem or 1 34 salary, their necessary maintenance and travel expenses while 1 35 engaged in official business. 2 1 Sec. 4. EFFECTIVE DATE. This Act takes effect May 1, 2 2 1998. 2 3 EXPLANATION 2 4 This bill provides for the appointment of a vice 2 5 chairperson of the board of parole. The vice chairperson is 2 6 to be appointed by a majority vote of the board of parole and 2 7 serves at the pleasure of the board. The board is also to 2 8 determine the duties to be performed by the vice chairperson 2 9 of the board. The position of vice chairperson is, like the 2 10 position of chairperson, a salaried position. The amount of 2 11 the salary of the vice chairperson, like the salary of the 2 12 chairperson, is to be determined by the general assembly. The 2 13 vice chairperson is to assume the duties of the chairperson in 2 14 the absence or disability of the chairperson or in the event 2 15 of a vacancy in the office of chairperson, until the governor 2 16 appoints a replacement chairperson.
