  1  4 RELATING TO THE OPERATION OF THE LOTTERY AND PROVIDING A
  1  5    PENALTY.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 99E.9, subsection 3, paragraph g, Code
  1 10 1997, is amended to read as follows:
  1 11    g.  The frequency of selection of winning tickets or
  1 12 shares.  Drawings shall be held in public.  Drawings shall be
  1 13 witnessed by an independent certified public accountant.
  1 14 Equipment used to select winning tickets or shares or
  1 15 participants for prizes shall be examined by lottery division
  1 16 employees and an independent certified public accountant prior
  1 17 to and after each public drawing.
  1 18    Sec. 2.  Section 99E.18, subsection 4, Code 1997, is
  1 19 amended to read as follows:
  1 20    4.  A person who, with intent to defraud, falsely makes,
  1 21 alters, forges, utters, passes, redeems, or counterfeits a
  1 22 lottery ticket or share or attempts to falsely make, alter,
  1 23 forge, utter, pass, redeem, or counterfeit a lottery ticket or
  1 24 share, or commits theft or attempts to commit theft of a
  1 25 lottery ticket or share, is guilty of a class "D" felony.
