1 1 Section 1. Section 356.15, Code 1997, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. The Iowa department of
1 4 corrections shall reimburse a county for the costs of
1 5 confining in a county jail or detention facility a person who
1 6 is being held due to a conviction of or being charged with an
1 7 offense against the laws of another state and whose
1 8 confinement costs are not otherwise reimbursable pursuant to
1 9 this section or chapter 356A. The amount to be reimbursed
1 10 shall be determined by multiplying the number of days confined
1 11 by the average daily cost of confining a person in the county
1 12 facility as negotiated by the department and the county.
1 13 Payment shall be made upon submission of a voucher executed by
1 14 the sheriff and approved by the director of the Iowa
1 15 department of corrections.
1 16 EXPLANATION
1 17 This bill provides that the department of corrections shall
1 18 reimburse counties for the costs of confining in its county
1 19 jail or detention facility persons convicted of or charged
1 20 with an offense against the laws of another state. The bill
1 21 provides that the department of corrections is required to
1 22 reimburse the counties for such costs only if the costs are
1 23 not otherwise reimbursable to the county from the United
1 24 States or a city pursuant to Code section 356.15 or from
1 25 another county or city pursuant to Code chapter 356A.
