PAG LIN 1 1 SENATE FILE 2348 1 2 1 3 1 4 AN ACT 1 5 RELATING TO THE LOCATIONS AT WHICH SHARED PUBLIC SCHOOL 1 6 SERVICES MAY BE MADE AVAILABLE TO NONPUBLIC SCHOOL 1 7 STUDENTS. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 256.12, subsection 2, unnumbered 1 12 paragraph 1, Code 1997, is amended to read as follows: 1 13 This section does not deprive the respective boards of 1 14 public school districts of any of their legal powers, 1 15 statutory or otherwise, and in accepting the specially 1 16 enrolled students, each of the boards shall prescribe the 1 17 terms of the special enrollment, including but not limited to 1 18 scheduling of courses and the length of class periods. In 1 19 addition, the board of the affected public school district 1 20 shall be given notice by the department of its decision to 1 21 permit the special enrollment not later than six months prior 1 22 to the opening of the affected public school district's school 1 23 year, except that the board of the public school district may 1 24 waive the notice requirement. School districts and area 1 25 education agency boards shall make public school services, 1 26 which shall include special education programs and services 1 27 and may include health services, services for remedial 1 28 education programs, guidance services, and school testing 1 29 services, available to children attending nonpublic schools in 1 30 the same manner and to the same extent that they are provided 1 31 to public school students. However, services that are made 1 32 available shall be provided on neutral sites, or in mobile 1 33 units located off the nonpublic school premises as determined 1 34 by the boards of the school districts and area education 1 35 agencies providing the services, and not on nonpublic school 2 1 property, except for health services, services funded by Title 2 2 I of the federal Elementary and Secondary Education Act of 2 3 1965, diagnostic services for speech, hearing, and 2 4 psychological purposes, and assistance with physical and 2 5 communication needs of students with physical disabilities, 2 6 and services of an educational interpreter, which may be 2 7 provided on nonpublic school premises, with the permission of 2 8 the lawful custodian. 2 9 2 10 2 11 2 12 MARY E.
