  1  4 RELATING TO HEPATITIS TYPE B IMMUNIZATIONS OF CHILDREN
  1  5    AND PROVIDING AN APPLICABILITY PROVISION AND AN 
  1  6    EFFECTIVE DATE.  
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  9 
  1 10    Section 1.  Section 139.9, subsection 2, Code 1997, is
  1 11 amended to read as follows:
  1 12    2.  a.  A person shall not be enrolled in any licensed
  1 13 child care center, elementary or secondary school in Iowa
  1 14 without evidence of adequate immunization against diphtheria,
  1 15 pertussis, tetanus, poliomyelitis, rubeola, and rubella.
  1 16    b.  Evidence of adequate immunization against haemophilus
  1 17 influenza b shall be required prior to enrollment in any
  1 18 licensed child care center.
  1 19    c.  Evidence of hepatitis type B immunization shall be
  1 20 required of a child born on or after July 1, 1994, prior to
  1 21 enrollment in school in kindergarten or in any grade.
  1 22    d.  Immunizations shall be provided according to
  1 23 recommendations provided by the Iowa department of public
  1 24 health subject to the provisions of subsections 3 and 4.
  1 25    Sec. 2.  HEPATITIS TYPE B – PLAN.  The Iowa department of
  1 26 public health shall develop a plan for protecting Iowans
  1 27 against hepatitis type B and requiring that minor children be
  1 28 adequately immunized against hepatitis type B.  The plan shall
  1 29 incorporate the health and religious exemptions in section
  1 30 139.9, subsections 3 and 4.  The plan shall be submitted to
  1 31 the governor and general assembly by October 1, 1998.
  1 32    Sec. 3.  RULES – APPLICABILITY.  Section 1 of this Act,
  1 33 requiring evidence of hepatitis type B immunization, shall
  1 34 first be applicable to enrollments for the 1999-2000 school
  1 35 year.  The Iowa department of public health shall adopt rules
  2  1 on or before October 1, 1998, to implement the provisions of
  2  2 section 1 of this Act.
  2  3    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  2  4 immediate importance, takes effect upon enactment.
