  1  4 RELATING TO THE ALLOCATION OF COST-SHARE MONEYS AS FINANCIAL
  1  5    INCENTIVES TO ENCOURAGE SUMMER CONSTRUCTION OF PERMANENT 
  1  6    SOIL AND WATER CONSERVATION PRACTICES.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 161A.73, subsection 2, paragraph b,
  1 11 Code 1997, is amended to read as follows:
  1 12    b.  The allocation of cost-share moneys as financial
  1 13 incentives to encourage summer construction of permanent soil
  1 14 and water conservation practices.  The practices must be
  1 15 constructed on or after June 1 but not later than August
  1 16 September 15.  The commissioners may also provide for the
  1 17 payment of moneys on a prorated basis to compensate persons
  1 18 for the production loss on an area disturbed by construction,
  1 19 according to rules which shall be adopted by the division.
  1 20 The commissioners shall not allocate cost-share moneys to
  1 21 support summer construction during a fiscal year in which
  1 22 applications for cost-share moneys required to establish
  1 23 permanent soil and water conservation practices, other than
  1 24 established by summer construction, equal the total amount
  1 25 available to support the nonsummer construction practices.
  1 26 The financial incentives shall not exceed sixty percent of the
  1 27 estimated cost of establishing the practice as determined by
  1 28 the commissioners, or sixty percent of the actual cost of
  1 29 establishing the practice, whichever is less.
