  1  1    Section 1.  Section 39.5, Code Supplement 1997, is
  1  2 repealed.
  1  3    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1  4 immediate importance, takes effect upon enactment.  
  1  5                           EXPLANATION
  1  6    This bill repeals Code section 39.5, which prohibits a
  1  7 local government from holding an election not authorized by
  1  8 state law but which specifically does not prohibit all local
  1  9 elections called pursuant to ordinance.  Presently, the Code
  1 10 otherwise specifies those instances when a local government is
  1 11 authorized or required to hold an election on a matter within
  1 12 the jurisdiction of the local government.
  1 13    The bill is effective upon enactment.
