1 5 RELATING TO THE CRITERIA FOR THE AWARDING OF GRANDPARENT
1 6 AND GREAT-GRANDPARENT VISITATION RIGHTS.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 598.35, subsection 6, Code Supplement
1 11 1997, is amended to read as follows:
1 12 6. The paternity of a child born out of wedlock is
1 13 judicially established and the grandparent of the child is the
1 14 parent of the mother or father of the child or the great-
1 15 grandparent of the child is the grandparent of the mother or
1 16 father of the child and the mother of the child has custody of
1 17 the child, or the grandparent of a child born out of wedlock
1 18 is the parent of the mother or father of the child or the
1 19 great-grandparent of the child is the grandparent of the
1 20 mother or father of the child and custody has been awarded to
1 21 the father of the child.
