1 1 Section 1. FISCAL YEAR 1998-1999 LOTTERY TRANSFER.
1 2 Notwithstanding the requirement in section 99E.10, subsection
1 3 1, to transfer lottery revenue remaining after expenses are
1 4 deducted, notwithstanding the requirement under section
1 5 99E.20, subsection 2, for the commissioner to certify and
1 6 transfer a portion of the lottery fund to the CLEAN fund, and
1 7 notwithstanding the appropriations and allocations in section
1 8 99E.34, all lottery revenues received during the fiscal year
1 9 beginning July 1, 1998, and ending June 30, 1999, after
1 10 deductions as provided in section 99E.10, subsection 1, and as
1 11 appropriated under any Act of the Seventy-seventh General
1 12 Assembly, 1998 Session, shall not be transferred to and
1 13 deposited into the CLEAN fund but shall be transferred and
1 14 credited to the state school district infrastructure fund.
1 15 Sec. 2. STATE SCHOOL DISTRICT INFRASTRUCTURE FUND
1 16 APPROPRIATION. There is established in the department of
1 17 management a state school district infrastructure fund.
1 18 Lottery revenues received during the fiscal year beginning
1 19 July 1, 1998, as provided in section 1 of this Act, shall be
1 20 deposited into and credited to this fund. All moneys
1 21 deposited into the fund and all interest and earnings from
1 22 moneys deposited during the fiscal year beginning July 1,
1 23 1998, and ending June 30, 1999, are appropriated to the school
1 24 districts in the state on a per pupil basis.
1 25 Each school district shall receive a portion of the amount
1 26 appropriated in this section equal to the ratio of the school
1 27 district's actual enrollment for the school budget year
1 28 beginning July 1, 1997, to the total actual enrollment for all
1 29 school districts for the school budget year beginning July 1,
1 30 1997. The department of management shall distribute to each
1 31 school district its share of the moneys appropriated
1 32 quarterly.
1 33 Moneys received by a school district under this section
1 34 shall only be deposited into the school district's
1 35 infrastructure fund and shall only be used for school
2 1 infrastructure needs.
2 2 Sec. 3. NEW SECTION. 298A.9A SCHOOL INFRASTRUCTURE FUND.
2 3 A school infrastructure fund must be established in any
2 4 school corporation that receives moneys from the state school
2 5 district infrastructure fund. Moneys received from the state
2 6 school district infrastructure fund shall be deposited in the
2 7 school infrastructure fund. Boards are authorized to deposit
2 8 any other moneys into this fund. At the end of any school
2 9 budget year, moneys remaining in the fund shall continue to
2 10 remain in the fund for expenditure during the following budget
2 11 year. Moneys in the fund shall be utilized solely for school
2 12 infrastructure needs.
2 13 For purposes of this section, "school infrastructure" means
2 14 those activities for which a school district is authorized to
2 15 contract indebtedness and issue general obligation bonds under
2 16 section 296.1, except those activities related to a teacher's
2 17 or superintendent's home or homes. These activities include
2 18 the construction, reconstruction, repair, purchasing, or
2 19 remodeling of schoolhouses, stadiums, gyms, fieldhouses, and
2 20 bus garages and the procurement of schoolhouse construction
2 21 sites and the making of site improvements. Additionally,
2 22 "school infrastructure" includes the payment or retirement of
2 23 outstanding bonds previously issued for school infrastructure
2 24 purposes as defined in this section, and the payment or
2 25 retirement of bonds issued for the purposes specified under
2 26 section 296.1.
2 27 EXPLANATION
2 28 This bill provides that lottery revenues received during
2 29 the 1998-1999 fiscal year, after expenses and prizes are paid,
2 30 are to be transferred to a special fund created in the bill.
2 31 Moneys in the special fund are appropriated to each school
2 32 district based upon the portion of its actual enrollment for
2 33 the previous year to the total actual enrollment for all
2 34 school districts for the previous year. Moneys received by a
2 35 school district are to be deposited into a school
3 1 infrastructure fund and these moneys shall only be used for
3 2 school infrastructure needs. These include the construction,
3 3 reconstruction, repair, purchasing, or remodeling of
3 4 schoolhouses, stadiums, gyms, fieldhouses, and bus garages and
3 5 the procurement of schoolhouse construction sites. The moneys
3 6 may also be used to pay the principal and interest on bonds
3 7 issued for those purposes.
