1 4 RELATING TO THE VALIDITY AND ENFORCEABILITY IN IOWA OF AN
1 5 ADVANCE DIRECTIVE DOCUMENT EXECUTED BY A VETERAN OF THE
1 6 ARMED FORCES.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 144A.3, subsection 4, Code 1997, is
1 11 amended to read as follows:
1 12 4. A declaration or similar document executed in another
1 13 state or jurisdiction in compliance with the law of that state
1 14 or jurisdiction shall be deemed valid and enforceable in this
1 15 state, to the extent the declaration or similar document is
1 16 consistent with the laws of this state. A declaration or
1 17 similar document executed by a veteran of the armed forces
1 18 which is in compliance with the federal department of veterans
1 19 affairs advance directive requirements shall be deemed valid
1 20 and enforceable.
1 21 Sec. 2. Section 144B.3, subsection 4, Code 1997, is
1 22 amended to read as follows:
1 23 4. A durable power of attorney for health care or similar
1 24 document executed in another state or jurisdiction in
1 25 compliance with the law of that state or jurisdiction shall be
1 26 deemed valid and enforceable in this state, to the extent the
1 27 document is consistent with the laws of this state. A durable
1 28 power of attorney or similar document executed by a veteran of
1 29 the armed forces which is in compliance with the federal
1 30 department of veterans affairs advance directive requirements
1 31 shall be deemed valid and enforceable.
