1 1 Section 1. Section 142B.1, Code 1997, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 1A. "Child day care facility" means a
1 4 facility which offers care, supervision, or guidance for seven
1 5 or more children by a person other than the parent, guardian,
1 6 relative, or custodian for periods of less than twenty-four
1 7 hours per day per child on a regular basis in a place other
1 8 than the home of the children.
1 9 Sec. 2. Section 142B.2, subsection 4, Code 1997, is
1 10 amended to read as follows:
1 11 4. Notwithstanding subsection 1 of this section, smoking
1 12 is prohibited on elevators and in child day care facilities.
1 13 EXPLANATION
1 14 This bill provides that smoking is prohibited in a child
1 15 day care facility as defined in the bill. A person who
1 16 violates this provision is subject to a civil penalty which is
1 17 a scheduled fine of $25.
