  1  4 RELATING TO AFFIDAVITS OF CANDIDACY FILED BY CANDIDATES FOR
  1  5    PUBLIC OFFICE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1  8 
  1  9    Section 1.  Section 43.18, subsection 9, Code 1997, is
  1 10 amended to read as follows:
  1 11    9.  A statement that the candidate is aware that the
  1 12 candidate is disqualified from holding office if the candidate
  1 13 has been convicted, and never pardoned, of a felony or other
  1 14 infamous crime and the candidate's rights have not been
  1 15 restored by the governor or by the president of the United
  1 16 States.
  1 17    Sec. 2.  Section 43.67, subsection 9, Code 1997, is amended
  1 18 to read as follows:
  1 19    9.  A statement that the candidate is aware that the
  1 20 candidate is disqualified from holding office if the candidate
  1 21 has been convicted, and never pardoned, of a felony or other
  1 22 infamous crime and the candidate's rights have not been
  1 23 restored by the governor or by the president of the United
  1 24 States.
  1 25    Sec. 3.  Section 44.3, subsection 2, paragraph i, Code
  1 26 1997, is amended to read as follows:
  1 27    i.  A statement that the candidate is aware that the
  1 28 candidate is disqualified from holding office if the candidate
  1 29 has been convicted, and never pardoned, of a felony or other
  1 30 infamous crime and the candidate's rights have not been
  1 31 restored by the governor or by the president of the United
  1 32 States.
  1 33    Sec. 4.  Section 45.3, subsection 9, Code 1997, is amended
  1 34 to read as follows:
  1 35    9.  A statement that the candidate is aware that the
  2  1 candidate is disqualified from holding office if the candidate
  2  2 has been convicted, and never pardoned, of a felony or other
  2  3 infamous crime and the candidate's rights have not been
  2  4 restored by the governor or by the president of the United
  2  5 States.
  2  6    Sec. 5.  Section 161A.5, subsection 3, unnumbered paragraph
  2  7 1, Code 1997, is amended to read as follows:
  2  8    At each general election a successor shall be chosen for
  2  9 each commissioner whose term will expire in the succeeding
  2 10 January.  Nomination of candidates for the office of
  2 11 commissioner shall be made by petition in accordance with
  2 12 chapter 45, except that each candidate's nominating petition
  2 13 shall be signed by at least twenty-five eligible electors of
  2 14 the district.  The petition form shall be furnished by the
  2 15 county commissioner of elections.  Every candidate shall file
  2 16 with the nomination papers an affidavit stating the
  2 17 candidate's name, the candidate's residence, that the person
  2 18 is a candidate and is eligible for the office of commissioner,
  2 19 and that if elected the candidate will qualify for the office.
  2 20 The affidavit shall also state that the candidate is aware
  2 21 that the candidate is disqualified from holding office if the
  2 22 candidate has been convicted, and never pardoned, of a felony
  2 23 or other infamous crime and the candidate's rights have not
  2 24 been restored by the governor or by the president of the
  2 25 United States.
  2 26    Sec. 6.  Section 277.4, unnumbered paragraph 3, Code
  2 27 Supplement 1997, is amended to read as follows:
  2 28    Signers of nomination petitions shall include their
  2 29 addresses and the date of signing, and must reside in the same
  2 30 director district as the candidate if directors are elected by
  2 31 the voters of a director district, rather than at-large.  A
  2 32 person may sign nomination petitions for more than one
  2 33 candidate for the same office, and the signature is not
  2 34 invalid solely because the person signed nomination petitions
  2 35 for one or more other candidates for the office.  The petition
  3  1 shall be filed with the affidavit of the candidate being
  3  2 nominated, stating the candidate's name, place of residence,
  3  3 that such person is a candidate and is eligible for the office
  3  4 the candidate seeks, and that if elected the candidate will
  3  5 qualify for the office.  The affidavit shall also state that
  3  6 the candidate is aware that the candidate is disqualified from
  3  7 holding office if the candidate has been convicted, and never
  3  8 pardoned, of a felony or other infamous crime and the
  3  9 candidate's rights have not been restored by the governor or
  3 10 by the president of the United States.
  3 11    Sec. 7.  Section 376.4, unnumbered paragraph 4, Code
  3 12 Supplement 1997, is amended to read as follows:
  3 13    The petition must include the affidavit of the individual
  3 14 for whom it is filed, stating the individual's name, the
  3 15 individual's residence, that the individual is a candidate and
  3 16 eligible for the office, and that if elected the individual
  3 17 will qualify for the office.  The affidavit shall also state
  3 18 that the candidate is aware that the candidate is disqualified
  3 19 from holding office if the candidate has been convicted, and
  3 20 never pardoned, of a felony or other infamous crime and the
  3 21 candidate's rights have not been restored by the governor or
  3 22 by the president of the United States.
