1 1 Section 1. Section 43.90, Code 1997, is amended to read as
1 2 follows:
1 3 43.90 DELEGATES.
1 4 The county convention shall be composed of delegates
1 5 elected at the last preceding precinct caucus. However, a
1 6 county central committee may adopt rules that allow elected
1 7 officeholders of that political party who reside in the county
1 8 to be delegates without the necessity of election at the last
1 9 preceding precinct caucus. Delegates shall be persons who are
1 10 or will by the date of the next general election become
1 11 eligible electors and who are residents of the precinct. The
1 12 number of delegates from each voting precinct shall be
1 13 determined by a ratio adopted by the respective party county
1 14 central committees, and a statement designating the number
1 15 from each voting precinct in the county shall be filed by such
1 16 committee not later than the time the list of precinct caucus
1 17 meeting places required by section 43.4 is filed in the office
1 18 of the commissioner. If the required statement is not filed,
1 19 the commissioner shall fix the number of delegates from each
1 20 voting precinct.
1 21 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 22 immediate importance, takes effect upon enactment.
1 23 EXPLANATION
1 24 This bill allows political party county central committees
1 25 to adopt rules providing for automatic seating, as delegates
1 26 to the county convention, of elected officeholders from the
1 27 political party who reside in the county.
1 28 The bill takes effect upon enactment.
