PAG LIN 1 1 SENATE FILE 2119 1 2 1 3 AN ACT 1 4 RELATING TO THE CORN PROMOTION BOARD, BY INCREASING THE 1 5 CEILING ON THE STATE ASSESSMENT OF CORN SUBJECT TO A SPECIAL 1 6 REFERENDUM AND AUTHORIZING THE RECEIPT OF RENTS, ROYALTIES, 1 7 AND LICENSE FEES BY THE BOARD. 1 8 1 9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 10 1 11 Section 1. Section 185C.21, subsection 2, Code 1997, is 1 12 amended to read as follows: 1 13 2. Upon request of the board, the secretary shall call a 1 14 special referendum for producers to vote on whether to 1 15 authorize an increase in the state assessment above one- 1 16 quarter of one cent per bushel, notwithstanding subsection 1. 1 17 The special referendum shall be conducted as provided in this 1 18 chapter for referendum elections. However, the special 1 19 referendum shall not affect the existence or length of the 1 20 promotional order in effect. If a majority of the producers 1 21 voting in the special referendum approve the increase, the 1 22 board may increase the assessment to the amount approved in 1 23 the special referendum. However, a state assessment shall not 1 24 exceedone-half ofone cent per bushel of corn marketed in 1 25 this state. 1 26 Sec. 2. Section 185C.26, Code 1997, is amended to read as 1 27 follows: 1 28 185C.26 DEPOSIT OF MONEYS. 1 29 State assessments collected by the board from a sale of 1 30 corn shall be deposited in the office of the treasurer of 1 31 state in a special fund known as the corn promotion fund. The 1 32 fund may include any gifts, rents, royalties, license fees, or 1 33 a federal or state grant received by the board. Moneys 1 34 collected, deposited in the fund, and transferred to the board 1 35 as provided in this chapter, shall be subject to audit by the 2 1 auditor of state. The department of revenue and finance shall 2 2 transfer moneys from the fund to the board for deposit into an 2 3 account established by the board in a qualified financial 2 4 institution. The department shall transfer the moneys as 2 5 provided in a resolution adopted by the board. However, the 2 6 department is only required to transfer moneys once during 2 7 each day and only during hours when the offices of the state 2 8 are open. From moneys collected, the board shall first pay 2 9 all the direct and indirect costs incurred by the secretary 2 10 and the costs of referendums, elections, and other expenses 2 11 incurred in the administration of this chapter, before moneys 2 12 may be expended for the purpose of market development. 2 13 2 14 2 15 2 16 MARY E.
