PAG LIN 1 1 Section 1. 1997 Iowa Acts, chapter 215, section 16, 1 2 unnumbered paragraph 2, is amended to read as follows: 1 3As a condition of receiving the appropriations in this1 4section, theThe department shallallocatereserve five 1 5 hundred thousand dollars of the appropriation for each fiscal 1 6 year described in subsections 1 and 2, to pay seventy-five 1 7 percent of the estimated or actual cost of improvements as 1 8 defined by section 468.3, not to exceed five hundred thousand1 9dollars each fiscal year,for a single drainage improvement 1 10 project, which will provide alternative drainage outlets to 1 11 allow for the closing of thirty or more agricultural drainage 1 12 wells, constructed by a drainage district established under 1 13 section 468.22 on or after July 1, 1987, and prior to July 1, 1 14 1997, for which a. As a condition to this payment, the 1 15 construction contract for the projectismust be successfully 1 16 let prior to March 1,19981999. Any moneys which are 1 17 unencumbered or unobligated following payment of the 1 18 improvements provided in this paragraph shall be used to 1 19 support the alternative drainage system assistance program as 1 20 provided in section 159.29B. 1 21 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 22 immediate importance, takes effect upon enactment. 1 23 EXPLANATION 1 24 In 1997, the general assembly enacted Senate File 473, 1 25 which established an alternative drainage system assistance 1 26 program administered by the soil conservation division of the 1 27 department of agriculture and land stewardship. The 1 28 legislation also created the alternative drainage system 1 29 assistance fund to support the program. House File 733 1 30 appropriated to the fund a total of $3,000,000 over two fiscal 1 31 years. As a condition of the appropriation, the legislation 1 32 required that up to $500,000 for each of the fiscal years must 1 33 be used to pay for 75 percent of the estimated or actual cost 1 34 of improvements for a single drainage improvement project, to 1 35 provide alternative drainage outlets to allow for the closing 2 1 of 30 or more agricultural drainage wells. That bill also 2 2 provided that a construction contract for the project must be 2 3 successfully let prior to March 1, 1998. This bill extends 2 4 that date to March 1, 1999, and requires the division to 2 5 reserve the $500,000 for each of the fiscal years in order to 2 6 support the project. 2 7 The bill takes effect upon enactment. 2 8 LSB 3410XS 77 2 9 da/sc/14
