  1  4 REGULATING ANHYDROUS AMMONIA BY PROHIBITING TAMPERING
  1  5    WITH RELATED EQUIPMENT AND THE UNAUTHORIZED
  1  6    POSSESSION AND TRANSPORTATION OF CONTAINERS AND
  1  7    RECEPTACLES USED TO STORE ANHYDROUS AMMONIA,
  1  8    PROVIDING ENHANCED PENALTIES, AND PROVIDING AN
  1  9    EFFECTIVE DATE.

  1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 
  1 12 
  1 13    Section 1.  Section 200.14, subsection 1, unnumbered
  1 14 paragraph 3, Code 1997, is amended to read as follows:
  1 15    1A.  All anhydrous Anhydrous ammonia equipment shall be
  1 16 installed and maintained in a safe operating condition and in
  1 17 conformity with the rules and regulations of adopted by the
  1 18 secretary of agriculture.  A person shall not intentionally
  1 19 tamper with anhydrous equipment.  Tampering occurs when a
  1 20 person who is not authorized by the owner of anhydrous ammonia
  1 21 equipment uses the equipment in violation of a provision of
  1 22 this chapter, including a rule adopted by the secretary.  No A
  1 23 person, firm or corporation, other than the owner and those
  1 24 authorized by the owner to do so, shall not in any manner or
  1 25 for any purpose sell, fill, refill, deliver, or permit to be
  1 26 delivered, or use in any manner any an anhydrous ammonia
  1 27 container or receptacle, including for the storage of any gas,
  1 28 or compound for any other purpose whatsoever, unless the
  1 29 person owns the container or receptacle or is authorized to do
  1 30 so by the owner.  A person shall not possess or transport
  1 31 anhydrous ammonia in a container or receptacle which is not
  1 32 authorized by the secretary to hold anhydrous ammonia.
  1 33    Sec. 2.  Section 200.18, subsection 2, Code 1997, is
  1 34 amended to read as follows:
  1 35    2.  Any A person violating any provision of this chapter or
  2  1 the rules and regulations issued thereunder adopted by the
  2  2 secretary pursuant to this chapter shall be guilty of a simple
  2  3 misdemeanor.  In addition to the imposition of the simple
  2  4 misdemeanor penalty, a person violating section 200.14 shall
  2  5 be subject to a civil penalty of not more than one thousand
  2  6 five hundred dollars, if the person does any of the following:
  2  7    a.  Intentionally tampers with anhydrous ammonia equipment.
  2  8    b.  Possesses or transports anhydrous ammonia in a
  2  9 container or receptacle which is not authorized to hold
  2 10 anhydrous ammonia according to rules adopted by the secretary.
  2 11    A person tampering with anhydrous ammonia equipment in
  2 12 violation of section 200.14 shall not have a cause of action
  2 13 against the owner of the equipment, any person responsible for
  2 14 the installation and maintenance of the equipment, or the
  2 15 person lawfully selling the anhydrous ammonia for damages
  2 16 arising out of the tampering.
  2 17    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2 18 immediate importance, takes effect upon enactment.
